Need Help With Spouses List Of Things To Do When Veteran Passes

I think I saw on this forum some time back a list of things a spouse needs to do when her husband passes away. I have had a major problem with my heart in the past couple of weeks and want my wife to have the easiest transition when the time comes.I am 100% service connected for congestive heart failure + seven additional service connected issues.I would appreciate all the guidance I can get.I know there are different forms for different things that need to be done and also who to contact. Thank you in advance for your assistance.You ladies and gentleman are the best.

Yes- it should be here USMC- when I get a chance I will either find that post or post this info again.

I cannot stress enough that a vets survivor-if they intend to ever apply for DIC-to have a complete autopsy done on the deceased veteran -particularily if the coroner is not going to list their SC on the death certificate as contributing.

If the veteran is an organ donor an autopsy is done here in NY for free by the Medical Examiner.Maybe in every state this is so.

And most organ donors are cremated.

And make sure the spouse can find a record of all your PC passwords-

I thank each and every one of you for your replies. Berta I had bookmarked that topic sometime ago but my computer had a glitz and I lost all my bookmarks. It was invaluable information that I hoped I would not need but imperative to have.If you could locate it I would certainly appreciate it. I located this forum about a year after I filed my claims, wish I'd have found it sooner but everything worked out well.You ladies and gentleman are great for assisting other veterans and I thank each and everyone of you.I visit this site on a daily basis and can't do without it. I guess you can say I'm hung on y'all.I don't contribute because I have a bad memory problem and would not want to give another person inappropriate information.Thanks again.

I need to know: How long (years) is the surviving spouse eligible to collect DIC; for the rest of their natural life? Can the surviving spouse collect Social Security and DIC? Thanks. ~Wings

Wings:

Yes can collect both.

The spouse can collect even after remarrying of they are over 55 as best as I can remember. The law was changed a few years ago.The second paragraph is concerning VA. Not at all sure about SSD,

Veterans deserve real choice for their health care.

Thanks Pete. The VA's Survivor Benefits Page is so full of bad links, I can't get any information from them at all!

Moreover, I've looked at the VA FORM 21-534 (DIC) and it's a little confusing. Best to get all these forms and details accomplished beforehand. ~Wings

Good Morning Wings,.... I also went to the VA's Survivor Benefits Page, and left, dazed and confused. Lots of rabbit trails and bad links. It seems to be the nature of Government sites ( world wide). I also called the 800 number, Wow, what a trip. I maneuvered thru the menu for some time, to reach a recording that told me to call back later. I finally called my NSO at the MOPH. RE: Is DIC received for the remaining life of the Spouse??? Short Answer: YES.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
