Question

I had a dro hearing few months back

i called 1800 # they tell me now they are waiting on transcripts whats transcripts mean

what happens next???

how much longer???

So Im curious to see what happens

Like I have posted before, my DRO would not even DISCUSS my issues. She sat there and asked me to explain what I was appealing. She mentioned multiple times that she would not even open my folder (and hadn't before the hearing) until the transcripts were back. The only input she had was "we will schedule another exam for that". My rep didn't say anything either. Not surprisingly since I had just met him 15 minutes before and he had no clue what my claim was and asked me to "pull the really important stuff out of your records (glad I brought them) and I will make copies so that you can really make a point about those".

He has never returned my calls.

VA still says to sit there and wait.

My hearing was Dec. 17th (over 4 months ago). They told me via IRIS (email) last week that they expect the transcripts to be finished within a month (the hearing was 20 minutes long max.). So 5 months to get the transcript and THEN the DRO will start reviewing my claim. And all I asked for was a increase from 10% to 20% for my knee and Service Connection for my low back problems.

Get a comfortable chair......... it's gonna be a looooooong wait.

My hearing was very serious because it delt with certain issues. I'll let you know how I make out.

I'll just mention this for what it's worth, if you look at all the Presidential Administrations that have offered to fix VA and what was actually done I don't have much hope for this guy either.

Here's some prior presidential excuses

It's going to take time

it s only been 90 days

it's only been a year

its only been two years

where hoping to resolve some issues on the re-election ticket

I talked to Jim Strickland and he's like don't hold your breath

good ploy though by saying it's going to take many years O'Bama re-sets the clock again

I am convinced the US likes the way VARO's are run one of my vietnam friends gave me a movie titled the RAINMAKER

and said thats why the US will never change the VA or the US govmnt will ever offer Socialistic Health care for americans.

never gonna happen!!

1.) As for VA money denied is money saved for them and the US

2.) HMO's are confusing and thats what the rich white proliteriate want, keep you confused so you pay while they play on st Kitts, the big pharmaceiticals run the US Health care industry and US Government.

3.) I mean look at the pledge of Allegiance and to the republic for which it stands with liberty truth and justice for all.

Justice?? Hum dont know bout that one.

4.) what federal institution violates peoples legal rights every day VA? is that a human rights violation

not allowed to have a lawyer until denial

Claims people presiding over federal precident? Isnt a judge supposed to do that

not allowed to bring witnesses

tainted comp and pension exams

i once watched the VA hospital take a veteran out of a wheel chair and forcefully move his body forward in pain to get the result they wanted i was in the hall looking down I was going to tell them to lay off the guy because he was in so much pain

problem their was the vet was a 96 year old man

then the doctor says to the vet see you can bend forward then they pushed him and the wheel chair out in the hallway where he stayed for the rst of the day till his ride came back to soldiers home

i saw this while i was waiting for my first medical many years ago.

It's my memory of that incident and seeing how the C and P exams are so tainted and then the sham hearings the VA run.

Really the only time you get a judge is at the BVA level and usually your not their and from what i heard as your case goes up the appeals ladder you the veteran has less interaction with the court deciding your case. due process justice for all??

America gives vets a fair deal/ ??? yeah and the devil has a dunkin donuts franchise in heaven

santa klaus is real and Im currently waiting for the Easter Bunny to come drop eggs

Think about this next last thought:

All the VARO's have metal detectors and security all over. Now the VA hospitals and outpatient clinics do not!!

Now you tell me whats going to happen next in VA history??

Just a matter of time my friend. because the VA hospitals do not have metal detectors its just a matter of time before they do.

When ever the BLIMES study is brought up oh they VA brass raise hell that will never happen VA is a Federal cash cow.

The system has been fragmented since day one its designed that way look at what you have to do to get a first claim approved.

Change for the VA should be quick and decisive early on in a new presidentail administration not reply its going to take time

some vets have or are running out of time

if a president wanted to make change it should be;

1 to give vets hope the system will change

2 to get rid of most of the bad personnel at the VA and effectuate their replacement

Ill put an uncertain smiley face on this one because as veterans we are all uncertain but hope full

Your DRO was on that CUE for the HB you should have gotten years ago, am I right. Then it is no wonder you got the quick denial. They planned to deny it all along. I think the VARO probably denies 99% of CUE claims just on principal. They just don't have the guts to approve a CUE because it would mean admitting a mistake and a big payday for the vet. They just hope you will give up and not pursue it to the BVA.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
