Question

My SO checked on my claim and where it is in the process and she was told that it was coming up for a decision in June.

Is this more hogwash to keep me in suspense and not checking each week or do they really know when your claim is due for a decision?

I'd like to believe my SO has a track on this, since she was given some type of code to look up in a binder I have seen her refer to after making a call to the VRO and talks to a cirtain person their. Seh has never steared me wrong yet, but as most of you may be aware, I'm bit parinoid where the VA is concerned.

What's your opinion?

I think maybe calling once every two weeks is enough. You just want to make sure the VA has not gotten off the track, or is needing some document that you can provide yourself. When I was waiting for TDIU the VA got held up because they said they needed proof from my old employer as to what my last day at work. The VA was going to ask the employer. I had the information myself in official form so I took it to them. That probably saved 6 months. They also said they did not have a DD214 for me.......what???? I had a certified copy so I brought that to them and save a few months I am sure. I think an IRIS inquiry gets more action.

Cowgirl: I do have Sleep Apnea, but it is considered only mild. I do however suffer from Nocturnal Hypoxia, which basically when I reach a Rim state of sleep my blood oxygen saturation levels drop below normal. It's due to a restrictive lung diesease I suffer from. I use a oxygen concentrator when I sleep to help keep my O2 sats up.

I also have to carry 02 with should I have to much physical activity, that too is related to my lung problem.

My sleep disturbances are due in part with restless leg syndrome, schizoinform dreams, and the latest being up and down every two to three hours to relieve myself because of the stent in my uriter to help me pass Kidney Stones, Ouch! LoL They got me on Oxycodone, but all it does is seem to sedate me and does little for my pain issue which are more than just the Kidney Stones.

My SO say I'm slated for a June decision on my latest claim, we'll see. Then I can formalize my TBI claim having caused a post traumatic organic personality disorder, a post traumatic organic depressive disorder, and a post traumatic adjustment disorder with anxiety and mood disorder.

They will probably combined them all together and rate them under the TBI criteria.

I've already been rated for a NSC adjustment disorder with anxiety at 50% and now I'm going to claim that as having been caused by the TBI. Their is plenty or reference material to show a strong nexus for this, so I'm not to worried about proving it.

I think IRIS is a joke, I contacted the VA in 2 different states and received replay from the same person.

BMC, are you sure that you were able to waive a wating period over the phone without paperwork? Thats very interesting.

Well that's what they said. Now, I don't totally trust anybody but my wife, so I wrote out a simple note waiving the 30 day period and faxed it to the RO, and IRIS'd the 10 day waiver. By the way, I did receive a date-stamped copy of the fax cover letter instead of the return fax I requested with the persons printed name and acknowledgment of receipt. After I faxed it, I dropped it in the mail. So, of the 3 ways I did it, one of them must have worked. But I was told over the phone they could put a note in my electronic file that I requested the waiver. I suppose i will never know if it actually worked ...

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.       Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
