For all here to know, I have now received the SOC and they included only what they wantd to look at what but nothing regarding objective laboratory evidence including the MRI or CSF finding that are absolutely key to this case.

The total number of pages was 28. I am amazed at what was said. Thay want war to be sure. For them to have begun counting -the days is rediculous when they took the time that they did and to lie like they did is amazing. I used to believe in the US system of justice but I am having my doubts at this point. I will never stop this claim.... I will try to reduce the page sizes and get at least part of the SOC here. I am amazed they could actually find a doctor who would say the BS that was said. They do not think except what is best for them. This is war now......My energy is down and now with Gio being treated for cancer and I going with her for her treatments is getting to the limit of my abilities. I will answer and go on to the next step that is for sure but it tears my heart out to see the lies I have seen.

Dont let this get you down----we have all been there with ridiculous SOCs.It is misery at first but then the fighting spirit will come through!

The above statement you posted shows what you have to work with to rebutt this-

They took a lot of information and then narrowed it down into the Reasons and Bases.

Those are the points to focus on-as well as breaking down anything wrong with the medical opinion they got.

This stuff makes me so angry- how many vets can afford a good IMO (which they often attempt to ignore if it supports the claim) yet we claimants have to somehow digest the medical rationale they deny with-

and practically have to become medical people ourselves in order to rebutt their doctor's opinions.

Take the time to calm down Josh and then assess what they have said-

They have to support ,with fact ,anything negative they have said.

The Reason and Bases part is the most important part that you have to deal with.

Dear Hadit members,

Included with this post is what is referred to as the "REASONS AND BASES"

Note there is no direct reference to lumbar punctures, or the specific MRI that showed a textbook abscess, nor any of the blood tests, or the THEIR DOCTOR´S diagnosis of a disease that does not exist (Intermittent Leukocytosis) .

Josh,

You, like other Vets, are just a XXX.XXX.XXXX number to them. Focus on your health, supporting Gio, and taking the SOC apart and do what you need to do.

When Joe finally got his C-file, he went into a deep depression, dealing with betrayal. So much was in his file that they completed ignored.

I went to the VA Radiologist to have an opinion. My wife was there with me. The Radiologist said that I had worked with mercury in my trade all my life, and that I was exposed to this toxic substance. The radiologist said that I had two children by my former wife. He said many more things that were untrue. When I got the FOIA release on his report my wife could not believe what this Dr. had said.

Chris could not even believe that she was reading my report. There were at least 15 erroneous statements that this Dr. had made. Each error was greater than the other. I started laughing about it.

I have been with my wife, Chris, for 28 years. My son is 25 and my daughter is 19, and both are from Chris and I. I have never worked with mercury in my life. I don't even know where he dreamed that one up.

I am going to show this Dr. his statements. I am going to ask him if he would like to reconsider. I will not say anything more than this question of reconsideration. I have been given a second chance many times in my life.

I am disappointed that your SOC came back like this. The shame of it is that you will have to wait for you SSOC. Then the BVA hearing. My SSOC had even more deletions of positive information and evidence.

I had my BVA video conference on 2-15-2006. I still have not gotten over the taxing situation. Today, the VA ran a tube down my throat into my stomach. They said that there were two biopsies taken. The Demerol and other drugs are still kicking-my-rear, right now. I have no idea why a biopsy was taken.

I would encourage you to stick with it, and you should not even think about giving up.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
