I Called the 800 number the other day and I was told they (VA) were going to send me to another exam. I expected that but I was not sure about what the exam was going to be for. I got a letter today and in a rush I opened it and started reading. It was strange I was reading a denial letter for a claim I did not file. I turned it over and the address is mine but the name is wrong. Funny thing is it has my complete address the street and number is correct. I called the VA and asked what is going on. I was expecting a letter telling me I was going to be scheduled for a C & P and I get a letter for someone else claim. I then called the VAMC C & P office and they told me what my C & P exam will be for. I just have to wait until they make the appointment. I was told to return the letter

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

I do not give my consent for anyone to view my personal VA records.

Sadly this happens all too often. And then the VA wonders how our (vets') identities are stolen??? Was your SSAN on the ltr or the other persons? I've gotten quite a few letters intended for other vets as well as phone calls/appts.

Unfortunately it was his, He has nothing to worry about when I called the 800 number I gave my information and the operator asked me the veterans name and SSN. I gave it to her so they can send the letter to the correct address. So it is in the computer system that I have/had his info but I do not plan to do anything illegal with the information. Who knows maybe he got my letter and I got his. I will return it to the post office return to sender tonight when I go out after I seal it up. No big deal. I was thinking it was my letter, sad to say that since it was a denial I am glad it was not my letter

...and, I received, while I had my claims in active status, not ONE not TWO but THREE letters that they had "mis-addressed". It was obvious that they had simply started to "make-up" names of streets that sounded "kinda" like my street (instead of, for example, "Oakdale Drive" they would send it to "Oakbrook Drive" or "Pinedale Drive" or "Oak Street".

Fortunately, my Post Office route carrier is an old GF of mine, and KNOWS where to deliver my mail.......otherwise I would have missed TWO C&P's and ONE DRO hearing....doing ALL KINDS of UNimaginable damage to my claims.

When I called and IRIS'ed the VARO about these "strange discrepancies" I was told not to worry about them, that they were just "honest mistakes".

DON'T WORRY ABOUT THEM.........hell no, I wouldn't worry about them, IF I WERE THEM!

HONEST MISTAKES..........HONEST, MY ASS.........all the little bullshit letters, ALL THE LITTLE BULLSHIT LETTERS, like the "we're sorry we're taking so long (yeah, right) with your claim.........but".....all THEM letters, they got to my house JUST FINE. ONLY THE MOST IMPORTANT LETTERS.......ONLY THEM were "HONEST MISTAKES".

And, there was my REAL address, right there, in their computer, right there........on PAGE FREEKIN ONE...of 4 different claims!

LIES, LIES and more LIES.............may they rot in hell!

BTW, give me a call and I'll tell you what I REALLY THINK.

"It is cold and we have no blankets.

The little children are freezing to death.

My people, some of them, have run away to the hills, and have no blankets, no food; no one knows where they are-perhaps freezing to death.

I want to have time to look for my children and see how many of them I can find.

Maybe I shall find them among the dead.

Hear me, my chiefs! I am tired; my heart is sick and sad.

From where the sun now stands, I will fight no more forever."

To show you how messed up things are. I got a copy of my medical records and found a page talking about a hysterectomy. Since I am a guy I don't thinks it's mine...It has someone else's info on it..including service record number

....and, BTW.....that is R*A*M*P*A*N*T.......

just sayin'

The VA is like my drunk uncle Ed -

1. He owe's you money but will never admit to it.

2. He is such a liar you don't know when he's telling the truth.

3. If you tell him anything personal he will find away to use it against you.

4. He's not at all particuliar about who he screws.

5. While in the middle of a game he will change the rules.

6. He is a jack of all trades master of none

Larry,

I blame all my misspelling on my drugs, But thanks for the correction. Hopefully I won't misspell it again. I don't have to give you a call because I think I understand your thoughts. If not I have my own understanding which is enough and of course I can't post them

Pete992 -

I would not return the letter to the VA.

I would track this other veteran down by using the internet - it's not too hard,

you can google with his name and SSA number.

Another web site you can try is www.zabasearch.com.

He would probably be glad to know about the VA sending his

personal info to someone else and for sure VA will not tell him about this blunder.

Since his claim is denied in that letter you could also tell him about www.Hadit.com

jmho,

carlie

Carlie passed away in November 2015 she is missed.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
