Notice of Disagreement is the start of an Appeal although you really don't have to call it a notice. It really means not much at all unless you complete and fill in a Form 9.

All Veterans need to study up on filing a Form 9 as you must include language that points towards your appeal including that all medical records including tests, and xrays and Doctors notes and SMR's be used to decide your appeal.

It seems that iof you do not spell it out than the VA ignores it.

Veterans deserve real choice for their health care.

BR, I would immediately file an appeal tomorrow. Let them know you dissagree with the rating assigned and that you request a higher rating. According to the regs you were LOWBALLED bigtime. Just a fraction of what's in your SOC should at least qualify you for a higher rating than 10%.

Many vets don't appeal and the VA knows this so they just flat out LOWBALL. They know it's a 50/50 chance the Vet won't appeal.

Frank, I filed a recon on july 30, what should I do about that? Should I wait & get a decision on it or file a NOD now? What the different between an appeal, NOD, & arecon? Thx Chow!!!!

I would file a NOD tomorrow.

I filed a reconsideration claim on July 30, 2009. Can I file a NOD also, shouldn't a recon take care of it?

Carlie,

1. Do you think his Decision is flawed since it doesn't give a rationale for not assigning a higher percentage? How is he supposed to appeal his Decision if they don't tell him why they didn't assign a higher rating?

2. Is a Reconsideration used ONLY when there's a CUE involved in the Decision? Do you know where in the M21-1MR it covers Reconsiderations at the VARO level?

Thanks,

TS
