Question

I posted on wed. I was unsure about filing a NOD on my Jan '09 decision. Well, I did. Hand delivered the papers to the RO wed. afternoon,got a signature and came home. 150 miles round trip but worth it. Out of curiosity, I called the 800 # this morning at 11:15 AM to see if it was in the system yet.I was told that this morning a DRO had requested a hearing on my NOD. I couldn't believe it, so I called again and was told the exact same thing. I was told on the second call that it will be after the first of the year before a hearing can be scheduled. Talk about the speed of light. I didn't know the VA could move so fast.

Do you think there is a legit reason for this or am I just being shuffled to meet someone's quota?

I've had the PAD ultrasound. It was negative for PAD. I am not working but I'm waiting till appeals are settled to file for TDIU. Being at 50% now and using the ratings tables, I should get 80% to 100%. I get 10% each lower and upper extremity now at a mild DX and 20% for DMII. The severe rating is 60% for each lower extremity, 40% for dominant hand and 30% for passive hand. If I read the combined ratings table correctly, Va math rating should be 100% and then add DMII.

I agree that there should be no problem with that claim at all.

Glad to hear you don't have PAD.

My IMO doctor included PAD in his diagnosis -in 2004 for my claim- 10 years after Rod died.

The VA couldnt even get that one right.

We need a VA funny math expert here for the ratings on this-

One thing to note is that the VA & DOD treatment guide has some language in it that in essence, state that Diabetes can exist for on the average of up to ten years before it is diagnosed. Having said that, the VA's M21 has a decision flow chart that tells the RO to deny if the other problems were diagnosed prior to DMII. In other words the VA does not give credence to it's own medical treatment documents. Further, there was some evidence that the VA started to "disconnect" the problems associated with DMII after congress made DMII presumptive by editing the M-21 to remove language that linked the problems to DMII as caused or aggrivated.

Didn't do it right but attach 3081 is decision, 3082 statements from C & P exams and 3083

is a list of DX problems as of Oct '09.

Yes I have been DX'ed with AHD.

MUGA scan in '01 at 48%, left heart cath in '09 at 50%.

I take simvastatin for high cholestorol.

yes to cataracts.

As I see it, everything hinges on proving I was diabetic prior to cath in '01. I have 2 hospital lab reports from '01 prior to cath showing glucose levels of 163 and 149.

do you think I have a chance with the NOD?

Update and question.

I received conformation that one hearing would be held for both NODs. Today I called the Appeals Management Board to see if a date had been set. I was informed that I would be going to Washington D.C. for a BVA hearing.

Can they skip the DRO hearing I requested and forward my NODs to the BVA without informing me?

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
