Wife Wants To Go Back To Vocational School

My wife wants to go to a vocational school. I have Chapter 35 benefits for her. How do I crank them up? We have about six months before the program starts. It lasts 11 months. It would be great for her since she is not disabled and needs some activity to make some money and stay busy. It would be a blessing for me too. I can't keep up with her. She needs employment. I wish I could also but I just pay the bills.

Don't you just go to the school and talk to the admissions counselor and get all older transcripts sent to them, and talk to the financial aid office and fill out all the necessary forms for school aid ie also for grants, federal aid, student loans, as well as chapt 35 forms.

The school generally have all the necessary forms to fill out for all $ aid necessary for tuition/fees/books, etc.

One has to apply for admission and be accepted to the program, and admissions will direct you/her to financial aid to follow through with the rest. Better to start early as it takes a while to get the process going, and to receive the funding too.

Make sure the vocational school is VA approved.

The best thing I did when I enrolled into college under Chap 35 DEA was to get email addy for the VA liason person at the school and then for VA Educational people.I delt with VA Buffalo for my Chapter 35.

I would email both the course info, course length, and tuition I paid with my student ID number etc in the emails-

DEA money comes after the tuition is paid and the student has been in the course for a few weeks.

One month I got 3 checks in one week as they were behind but it usually went smoothly. I finished my degree under DEA with an on line college.

Your wife -if at a campus-has opportunity to get her DEA course info to the VA perhaps even faster then I did as the VA liason should be readily available at the school.

As others said she needs to apply for the Certificate of Eligibility.

Has she filled out the entire Chapter 35 application yet? It should have come with the DEA award letter.

Unfortunately due to the GI Bill backlog -there can be a 30 minute or more phone wait for a DEA counselor but the college VA liason person should be able to help tremendously getting the ball rolling for her DEA.

The school surely has a web site too and this might help her with enrollment questions.

John when me daughters went they dealt with counselors at the school and the did all of the paperwork with the VA, I never had anything to do with it but they never went to a regular college like my son is debating about now, go to college or join the army, I would prefer he go to college first and then if he wants to join the Army

His girlfriend said he was going into the Army for college benefits, I made the mistake of telling her that was foolish since I already had eligibility for him thru both Chaper 35 from VA and here in South Carolina they give children of 100% veterans free tuition at any state college they want to attend he doesn't have to join the military for college thats one bill that is paid for him actually he will get paid to go to college so I don't understand it I hope he isn't joining the military so he can get married because then he will never get a degree I have seen to many people think they can do it all and they can't something usually gives the school, the relationship or they end up in trouble in the military too many things demanding time and that much juggling ends up everywhere

don't get yourself in trouble while she's gone to school rofl

John -I forgot something DEA will more than likely approve the Vocational school-

DEA benefits are different from GI Bill stuff.

http://www.gibill.va.gov/pamphlets/CH35/CH35_Pamphlet.pdf

They even asked me dates of my 2 Certificates-one was Cert in Agriculture (Penn State) and the other was from NVLSP

They sure wont pay to take the NVLSP course but would have paid for my Penn State Cert if it was in the eligibility period.

I also have a Cert in Military Studies too that was paid for under DEA but I also earned degree credits for it-

Your wife might have many options under DEA.I couldnt find my DEA pamphlet but it is at the link above.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
