SHE STATED IN HER C+P EXAM THAT MY SCHIZOPHRENIA/SCHIZOAFFECTIVE DISORDER WAS FIRST DIAGNOSED IN THE SERVICE AS PER THE SERVICE MEDICAL RECORDS.THEREFORE THE PERSONALITY DISORDER THAT THEY POSTED IN MY SEPERATION PAGES WAS INAPPROPRIATE( THIS IS THE VA C+P EXAMINER STATEING THIS)I WAS DENIED IT IS GOING TO DRO SOON,DO I HAVE A LEG TO STAND ON ACCORDING TO THE C+P EXAMINERS OWN REPORT,I WAS OFFERED SERVICE CONNECTION FROM PSYCH DRS IN USMC ON THE GROUNDS I TOOK MEDS.I REFUSED MEDS,YOUNG+STUPID.SO THEY PUT ME DOWN AS PERS DISORDER=NON COMPENSATIONAL.THANKS FOR FEEDBACK

On the C&P examination did the examiner refer to any specific SMR's

that indicated a diagnosis for "SCHIZOPHRENIA/SCHIZOAFFECTIVE DISORDER"

while on active duty or on an exit physical ?

If not, then did the examiner refer to any mental health diagnosis at all

during active duty OR opine on the Personality Disorder they have of record ?

Do you have copies of your SMR's

If yes, can you find the diagnosis of "SCHIZOPHRENIA/SCHIZOAFFECTIVE DISORDER"

somewhere in them ?

The VA is clinging to the Personality Disorder DX in hopes of being able to deny SC. If you have SMR's that state a DX of schizoprenia, and your C&P doctor agrees I think you have a very good chance of getting SC'ed. I was kicked out on a PD discharge. The VA said it was schizophrenia even though I never got a C&P exam. I got rated for schizoprenia. Your position is stonger than mine was I think. Are you in treatment for your mental health problems at the VA? This is important long term. Are you taking meds. I think your claim can be won. Don't give up whatever you do. I was in a military nuthouse for about two months. I did not want a mental health discharge being crazy at the time. The Army then discharged me as a PD. They wanted me out and they got me out.

As John says you have a strong claim and do not give it up. Never under estimate the VA's ability to confuse and delay a claim. It could be a battle. However. the good news is that there have been about ten veterans that I am famaliar with here on hadit over the last fifteen years who were sucessful in having inservice diagnoses changed. There was one case where the veteran recieved a favorable C&P exam and the RO ignored it. The RO then scheduled a C&P exam with a board of two clinicians. One said the veterans mental condition was service connected and the other said it was not. The veteran eventually got a private independent medical opinion and won the claim.

MY C+P EXAMINER DID NOT MENTION SPECIFICS,BUT SHE SAW THAT MY ADMISSION PAPERS INTO PSYCHIATRIC WARD IN CAMP LEJEUNE STATES,HE IS BEING ADMITTED INTO OUR HOSPITAL WITH A DIAGNOSIS OF" SCHIZOPHRENIA" THE WORD SYCHIZOPHRENIA WAS IN CAPITAL LETTERS WHILE EVERY OTHER WORD IN DOCUMENT WAS IN SMALL LETTERS,BUT BECAUSE I REFUSED MEDS AT THE TIME THEY MADE THERE FINAL DIAGNOSIS OF BORDERLINE PERS DISORDER.HOW CONVENIENT FOR THEM. NOT TAKING THE MEDS WHILE SPENDING 6 WEEKS IN THE WARD WAS THE BIGGEST MISTAKE OF MY LIFE. I HAVE A TWENTY YEAR HISTORY OF RECORDS FROM VA HOSPITAL,14 HOSPITALIZATIONS=ALL FOR SCHIZOAFFECTIVE DISORDER AND THE MEDS THE WHOLE TIME. MY DR NOW SAYS SHE READ THE C+P EXAM AND WAS SURPRISED THAT I WAS NOT SC'D .MY PRESENT DR SAYS SHE WILL TRY TO HELP BUT SHE TOLD ME THGAT SHE WAS TOLD BY HER SUPERIOR NOT TO USE THE PROPER TERMINOLOGY THAT WE ALL SEEK.THEY CAN SKATE AROUND IT BUT WITHOUT THE SPECIFIC TERMINOLOGY"MORE THAN LIKELY SERVICE CONNECTED""AS LIKELY AS NOT SC'D" THE VA FINDS A WAY TO THROW AWAY IT'S VETS.THANK YOU FOR YOUR REPLY,

I rarely say this but I would be very surprised that if that is a current diagnosis that you would not win your claim.
