Feres Is Being Attacked In New Lawsuit

I know many of you know I am one the Edgewood Veterans and I have some really bad things to say about the Army, the VA and the CIA but the lawyers that are handling the Edgewood Testvets lawsuit for the VVA and Plow to Plowshares amended the complaint on 7 June 2010 and I read things in the new complaint that I had heard about but wasn;t really sure about "septal implants" yea right that only happens in the movies right? No it turns out the lawyers found the Doctors name that did them and that he was funded by DARPA read the entire complaint I knew about most of it and I could NOT stop reading it. VA Watchdog posted it last night I didn't even get a heads up from the lawyers.

I will sure take the time to read and re-=read all this Mike.

Looks like much more evidence has been compiled.

Gordon P. Erspamer is an outstanding lawyer and many of us are familiar with his successes with VA.

ALL veterans subjected to these types of military testing should not only file claims if they believe the tests caused them disability- but they should keep well informed of this lawsuit.

The Feres Doctrine- to me- means license to harm or kill our own with no accountability at all.

I guess they sure dont read the Feres Doctrine to anyone at the recruiting stations.

Am I dreaming but I was under the impression that there are Bills in Congress to overturn Feres. Course we all know that every two years a bill is submitted to allow Disabled Vets to use Military Travel and never makes it

By the way I am not optimistic about the current supreme court doing anything on this issue

Veterans deserve real choice for their health care.

The complaint is overwhelming with tie in to the DVA.

It will take me some time to digest all of this.

I sure hope every vet here reads all this.

This has staggering ramifications.

Berta I thought I had seen all the evil possible NOPE this new filing NAILS all of the agencies the Army, the Navy, DARPA, CIA, NSC, DOD the VA itself it nails all of them I was shocked to read where they bombed and killed the American prisoners in chemical tests in Australia in 1944, the brain implants this is the stuff of bad movies right yet they did it and they got worse after the Supreme Court passed the FERES case in 1950 but I think Gordon Erspamer has the govt by the short hairs this time I am still in shock and coming to grips with everything this filing spells out but it shows we really treated our nations soldiers and veterans no better than lab mice.....

If overturning Feres is going to cost the government money and add to debt the lawsuit will sink. Congress will pass a new law to get around anything done in the courts. It is not a matter of right or wrong. It is a matter of money. Uncle Sam created Feres to protect treasury. Now more than ever the mood is to cut government spending. If courts kills Feres the congress and Prez will pass a new law that does the same as Feres. That is just my opinion. Feres has existed under both Dems and Repubicans. The motive for preseving it is the same.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
