Feres Is Being Attacked In New Lawsuit

I know many of you know I am one the Edgewood Veterans and I have some really bad things to say about the Army, the VA and the CIA but the lawyers that are handling the Edgewood Testvets lawsuit for the VVA and Plow to Plowshares amended the complaint on 7 June 2010 and I read things in the new complaint that I had heard about but wasn;t really sure about "septal implants" yea right that only happens in the movies right? No it turns out the lawyers found the Doctors name that did them and that he was funded by DARPA read the entire complaint I knew about most of it and I could NOT stop reading it. VA Watchdog posted it last night I didn't even get a heads up from the lawyers.

John then if congress IS that stupid they need to go on the record with their votes but if any court case is going to make the Supreme Court to finally repeal FERES this one screams for justice then let Congress stick it to the veterans then the nation will KNOW who it is instead of hiding behind the Judges........

Don't get me wrong. Feres is an abomination. I just think that whatever the court does the congress will undo because billions of dollars are on the line. You were a postal worker. You know that FECA lets the civilain federal government absolve itself of injuries to employees even if agency is grossly negligent. They just pay workers compensation even if they sent you out on route with no brakes and they knew it. The governmetn protects itself.

John I remember when the Post Office bought us big tricycle's back in the early 80s to deliver mail instead of using jeeps it was a "test" using relay boxes it lasted about a month the only thing worse than being in a jeep riding down the street delivering mail is riding down the same street on a huge tricycle and have some car slam into you the post office had no respect for employees and I doubt it has improved since I left in May 2000. I have had 2 carriers on my route retire on SSD, and VA pensions since I moved in to this house must be in the water rofl

This stuff should be first page headlines on every major newspaper- of course it won't be-

our grateful nation is grateful to vets I am sure but they are also forgetful of their sacrifices and this situation is an absolute National Travesty.

Isn't there much evidence that the chemical companies and the military knew that AO was dangerous. They went right ahead and used it anyway. Now they pay compensation to victims of premeditated murder. No one in government went to jail and nobody at DOW was hung by the neck. If exposing 3 million military members to AO is not a war crime what would be? I hope he suit against Feres succeeds.

John I agree about the issues about AO who can't it's to dang obvious but the lawyers that dealt with those lawsuits made the deals to take the money I don't know if any of the AO lawsuits ever tried to overturn Feres Gordon has already been told by the Judge in previous filings that she does NOT want to address any FERES issues, this 3rd filing is to filled with facts about DARPA, the VA, etc that if the Federal Judge tosses it, then it will be appealed to 9th Circuit and then on to SCOTUS I wonder if I will even live long enough to see that day come But I do have to admit when I first heard the brain implant story about 4 years ago I had a real hard time believing that, now Erspamer has found the doctor who did it and who he was working for at the time DARPA and that the VA itself was conducting experiments using some of the same substances the VA still does a lot of clinical "trials" my shrink won't even ask me about "volunteering" again for any of them, I think there is a note somewhere in the computer files about me and experiments even the PC docs won't ask to to sign up for any of the clinical trials......we know that some medical research is necessary for cures but what is for the "good of the patient" and what is just plain BS and the researchers don't care about the short or long term effects on the "volunteers" it just leaves to much wiggle room for them to abuse veterans again I know it's needed but Ijust can't bring myself to ever sign a "waiver" for the govt again I wrote that blank check once in Oct 1973 when I enlisted and then in May 1974 when I "volunteered" for Edgewood NEVER AGAIN

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
