If TDIU is based solely on one single SC disability (as in your case they could consider TDIU based on DMII and the secondarys it caused- then a 60% additional independent rating (such as in your case -for the IHD- if your medical evidence warrants that rating)would set you up for TDIU plus SMC at the "S" level."

Then again it depends on how they award the deferred issues.

Not only do AO vets now have chance to get their IHD service connected -when the proposed rule becomes law, but the extensive information that was posted at the Federal Register site when they were seeking public comment does consider that VA has already determined most of the AO IHD awards will be at 60 %.

This gives many AO TDIU vets a chance now for SMC at the "S" rate.

60% for DMII, PNx4, Macular Degeneration, and SMC-K for ED.

Effective date December, 09 2009.

IHD, Hep-C, and IU deferred.

PTSD and Retinopathy denied.
