Question

I can't figure this out! When I received copies of my SMR there wasn't a hospital record of my airbourne accident which was the only proof of it. The only record in my SMR was my exiting exam which I stated the accident in. But I still was awarded 30%, increased to 60% on right knee. NOW, I'm not complaining trust me! I was just wondering if the VA has any records that I don't? I'm about 100% sure they didn't award my claim just on my statement aone. I'm sure it's has to be that hospital record that I don't have. Has anybody been thru this before? I mean besides getting copies of my c:file, in which I'm going to do.

I'd wait until I received my c-file and had a good look-see at it, before expending any more energy on your medrecs.

Yeah I will. Kind of makes me wonder what they do have! I hope it is the record I'm hunting for cause I can prove more inservice claims!

The exit exam may have been enough to prove "at least as likely as not". But, to assign a %, the VA needs something else. Perhaps your statement was the tipping point, as it seemingly was consistent with the exit exam details. Who, knows, maybe the rater was told to approve a claim, (Gotta meet goals) and yours was on the table. It's also quite possible that you were not sent a complete copy of your SMRs. It happens.

I will say this, as bad as we slam the VA Regional offices around the country, they tend to have all the info, you are looking for, however, you will have to go through it all and point out (highlight) the info. I am talking about getting your C-file.

I have one issue I am claiming that is in my service medical records, however, the records I have with me I couldn't find. I requested my C-File and sure enough it was in there. I will say this, if you do not send them any proof, chances are you will not be granted the benefit. At that point request your C-File, once you receive the C-File take your time and review all the info. I would be willing to bet it will be in there...
