The depression is caused by illness, which was caused by illness on and after active duty, service connected. I am rated at 50% for illness from Jet Fuel, on active duty. I have claims in for more ilnesses, and also for depression. The depression is from the illnesses. I was never see for depression on active duty. I just had two C&P exams for neurological issues, and for medical. I was never sent to an exam for spression for my claim. But, I have been seen many times for depression at the VA for 15 years. I just wondered why they never sent me for a C&P exam for depression. maybe they have enough evidence for the depression with more exams? justrluk Posted August 17, 2010 Share Posted August 17, 2010 I think you're right - they may have enough evidence without a C&P exam. Have you been seen by anyone outside the VA? If you are asking "Can they make a decision on your claim WITHOUT a C&P examination, then the answer is YES. If they have enough information to make a decision without having to go through a C&P exam. If you have been treated for depression via the VA and have a treatment regimen and history of depression, then I would think a C&P would certainly be un-necessary. Moderator pacmanx1 Posted August 17, 2010 Moderator Share Posted August 17, 2010 VA can process your claim and make a decision without giving you a C & P exam. If a veteran files a claim and VA does not process it, deny it, or low ball it , the veteran can then file a claim for CUE for that issue. If the veteran has well documented evidence in his or her file and VA fails to process the claim then the veteran can ask VA to reconsider the evidence and keep his or her original claim date.
