Subpoenaed For Jury Duty

I received a subpoena for jury duty.

I truly do not see myself being able to due my civic duty in this way.

Several years back I was I received one and my PCP wrote out a letter for me to support

the fact that I was not physically or mentally able to do this, so I was released.

Now I have this new subpoena and am not seeing any PCP -

I took it to the Vet Center where they DO HAVE a Licensed PHD Psychologist and was told to contact my

Psychiatrist at the VAMC.

It is a bit difficult to get an appointment with her but I will try to do this tomorrow, (set up an appointment).

I am wondering why I got this new subpoena as the last one I sent them the letter from my PCP

along with a copy of my SSD award.

As rotten and mean as I can get - they really don't realize it - but I'm sure they would not want me there.

Has anyone else here dealt with this situation ?

I do slowly, pick up trash up and down our road - that's what I can do.

Carlie passed away in November 2015 she is missed.

I called them up again today and told them my next Drs appointment is in November.

They said write that on the form - send it in and they will extend my date 60 days.

I am kinda peeved that they are wasting money on trying to subpoena people like me

for jury duty - SSA disabled with congestive heart failure, ptsd, seizures etc...

and 60 percent VA disabled - what the heck good do they think I can do.

I think I may just go ahead and show up for it - I'm sure they won't need to ask me

more than one or two questions - hear my answers and say dismissed.............

I'm called up for Jury Duty, okay?

So, I show up. Riding the elevator up to the jury selection room I'm listening to The Suits talking to each other. One says, well he thinks that his client is a schmuck and is probably indebted to this other Suit's client, but that he has to make sure and give his client the best defense, yada, yada, yada, and the other Suit says that his client probably IS a shister and probably did misrepresent the true value of what the other Suit's client thought he was getting for the money that he put down on this purchase.....yada, yada, yada. So, about this time the elevator doors open to the floor where the jury selection process is supposed to be going on. I turned around and said "Look, there are a lot of fine people that showed up today, to help render "justice" and to fulfill their "civic duty" and this time off from work is costing ALL these fine folks, and, in the meantime, you two Suits don't like either OR any of your clients' and probably think that both your clients are, essentially, WRONG. Why don't YOU TWO go back downstairs, get a cup of coffee and get this taken care of, you know, and let us ALL GO HOME.

20 minutes later we were all excused.

I just walked in with my walker and my shopping bag of meds including the percs the clerk asked me a few health questions the Judge then asked me to if I could stand up and safely walk out of the courthouse or did I need someone to get me a wheel chair and my wife and I would never be called for jury duty again dang took all the fun out of that day the last time a cop tried arresting me the Chief of Police asked him if he was ignorant or something did he have any idea how expensive cardiac care was at the local hospital and I am a walking heart attack unless he had video of me killing someone I was not to be arrested and just issued a citation on when and where to appear in court the county can't afford my medical bills for misdemeanor offenses works for me it also helps that I quit drinking too rofl

Mt third son took me to VA for an appointment with Dentist and also stopped by and got paper work certified for Texas free Drivers License.

Mrs Pete had some things she wanted picked up including some meds so after I filled the cart Kyle took the groceries and waiting in car in handicapped parking for me as I was pretty much done in from the walking last couple of days,

A guy came to car and jumped on Kyle for not having license for handicap zone and bless my son he did not punch him out or anything like that but he did get out of car and display his very health 325 lbs and the guy ran away. I explained to Kyle in Texas that yes some Vets don't make all the qualifications on normal handicapped plates but Texas threw us in and we get even more benefits than handicapped.

I said by the way you could have opened the glove box and I have a current blue placard.

Veterans deserve real choice for their health care.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
