Extra-Scheduler Iu

Question

I am currently at a 50% rating.

30%lumbar fracture, and 30% pain/mood disorder. I have not been employed since 1994

Been receiving SSD since 1996 and VA Voc rehab. states that they can no longer help me.

I have statements from my counselor that I am unemployable and sent letters from family members who state my current condition and how it affects my daily life.

I filed the proper forms for IU but on the from did not specify that I was requesting an extra scheduler IU 4.16b.

Now they have been working on my claim. I have sent them previous employers and my SSD award letter(granted due to service connected disabilities)

Will they come back and deny me cause I was not specific in telling to request this certain type of IU?

Can I call or send and letter and requesting a certain type of IU at this point or now do I have to wait to have them send me out a decision??

Okay, I'm going to try to help you out here a little bit.

1. The corrrect form for instituting a claim for IU is VA Form #21-8940, VETERAN'S APPLICATION FOR INCREASED

COMPENSATION BASED ON UNEMPLOYABILITY. http://www.vba.va.gov/pubs/forms/vba-21-8940-are.pdf This form is, in all actuallity, a form for an increase in compensation due to an increase in your degree of disability of an existing service-connected disability.

2. The "IU" that you are referring to is actually, properly, referred to as TDIU which stands for "T"otal "D"isability due to "I"ndividual "U"nemployablity. This means that you are seeking total disability (100%) due to the fact that you are "unemployable" because of a condition that, although not great enough to cause a "schedular rating" of 100%, but that the condition is severe enough to cause you, in your particular "Individual" instance, to not be able to be employed.

3. Once you have sent this form 21-8940 in, then you will either be scheduled for a C&P to determine whether you are, in fact, unable to work, or they will just go ahead and grant you your TDIU based upon the progress reports of your psych team and/or the existing evidence of your Social Security profile.

No, they will not come back and deny you because you did not tell them what type of IU you were seeking (because there is just ONE type of TDIU and not a whole gamut of types).

No, don't call them and tell them anything at this point, if they are in fact working on your claim. You'd just muddy the waters, which, TRUST ME, you do NOT want to EVER do.

Thanks LarryJ.....I did file the VA Form #21-8940 just get to second guessing myself.....just trying to cover all the bases....your right....I need to do something more than just thinking about this stuff 24/7 just consuming me.

Just asking . . . because I would've recommended he follow it up w/a letter requesting extra-schedular, should they deny the TDIU.

I agree Phillip, "IF" they deny the TDIU.....................BUT, he seems to have all his quackers in a row for his TDIU claim, and, as we all know, it is best NOT to befuddle the folks at the Regional Offices with a multiplicity of claims. BUT, as you said, IF they do deny his TDIU then I'd be down at his Regional Office the very next business day with an app for extra-schedular. But he seems to be inline for TDIU, nicely.

I would agree and do the same, being that empty's profile shows 50 % SC.

Carlie passed away in November 2015 she is missed.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
