Question

I was recently awarded 20% for my Lowerback however I underwent two surgeries(back) in the Military and I feel this was an unfair %. How do I file a disagreement to get a higher claim?

You have to file a NOD (Notice of Disagreement) with the VARO. I would suggest that you check out this link http://www.benefits.va.gov/warms/bookc.asp Go to the rating section for your disability, and see if you meet the higher rating.... you can also go through and see if there are any other ratings that could be included with it!!

You can file a NOD but first check wat criteria it is rated under. There are 2 distinct criteria for the Back or Thoracolumbar spine. IVDS or Traumatic Arthritis.. One uses a spacific range of motion and the other uses incapicitating episodes. Also check it there are any neurological defects or radiculpathy. Sciatiic nerve is a common one.

vet2010,

First off - congrats on the 20% you got granted.

Second - having the two surgery's while you were in the military

is probably the reason that SC was granted - but those surgery's

are not a factor in determining your evaluation (percentage) at this time.

The evaluation that is granted factors in your current level of disability.

If possible, post exactly what is stated in the Reasons and Bases section of

the rating decision that granted the 20 %.

What are the reason/s, (shown by medical evidence)that you feel you should be awarded

a higher percentage.

Keep in mind that you were (supposed to be) rated on the evidence of record

at the time the decision was made.
