Va Form 21-6789 Deferred Rating Decision

I received this form with my C&P results for Parkinson's. Here is what is on the form:

No box is checked for reason(s) for the deferral.

EP405

Sensitive Access Required

1. The claim for Parkinson's Disease signed on 02-12-11, by the veterans spouse and son cannot be accepted in the absence of a definitive finding of incompetency by a physician; and their appointed fiduciary (ies).

2. Send DT1 letter informing the vet and/or his representative that although electronic Fast Track VCAA letter was sent on 02-12-11, by regulation, we are not permitted to accept or act on correspondence regarding the veterans VA benefits unless it is signed by the veteran himself or his appointed representative.

3. Although it is shown in SHARE, there is no documentation of Mr. Xbeing appointed as the veterans representative. The VAF 21-22 of record for POA is for DAV, so the claim received 02-07-11, also should not be developed without revocation and authorization for the private attorney.

4. Review with SVSR, but I believe the pending claims should both be PCHG'd to EP400 until authorization is received.

5. Update tracked items and claims level suspense in MAPD and SHARE as necessary.

Can some one please tell me what all this means? My family was not dxing me for Parkinson's disease, but only telling what they had observed. They are saying that I did not sign the VCAA letter. Of course, I did not. It was suppose to be electronic. What does SHARE, MAPD, mean? I'm totally confused. I believe I have a VAF 21-22 POA for Mr. X.

Welcome to Hadit Boots.

I guess it means that for some reason the VA will not accept your wife's and sons claim. I am not familiar with the form but if you want the VA to work on your claim you need to make them happy.

oops looks like they sent that by accident. That's a blue deferred sheet that raters and appeals DROs use to send instruction for further development. it should have stayed in the folder, but i guess they missed it. MAPD is our claims development system and SHARES is how we control end products like 405. I would just send a VA Form 21-4138 explaining that you are indeed claiming (or not) parkinson's & explaining that the previous correspondence by family are just observations. Your signature on the 4138 will count for claim. If you have a 21-22 for Mr. X, send it again. You will most likely be sent for a VA exam called a DBQ (disability benefits questionnaire) for parkinson's.

Actually, getting the sheet is fortuitous, in that it identifies what they want. Knowing that can be a great help in getting the documents and stuff together, and sent to them.

True, Chuck. At least this way u see what's going on.

A DBQ exam is for a specific condition, usu. the3 new ones (parkinsons, CLL & ischemic hert disease) that are now deemed to be due to AO by the courts (the whole Nehmer thing). It's just a template that the docs have to follow. Of course, the VA docs are in an uproar over some of the things on the template becuz again it was put together by some genius in Wash. DC that has no flipping clue what he's doing. For instance, the METs that are the bitg determinate on the ischemic heart disease are actually no longer used by medical professionals outside of VA as it has been deemed an inaccurate measure of metabolic heart rate, yet is the determining factor for our ratings. Yet I'm sure that guy got paid big bucks to come up with the DBQ template. grrrr.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
