Question

I really need help and advice. I filed a claim for Parkinson's disease back in Jan 2011, and I used the Fast Track system. I did everything that the site wanted me to do. I had a C&P exam around Mar 2011. I thought everything was done, but I requested copies of all my claims from the VA, and received them, along with an internal VA form that indicated that my Fast Track claim was moved to the general pile of claims, it also indicated that there was no VCAA signed. I had signed it electronically. What is so frustrating is that I was removed from ebenefits, someone removed my military and other data from my files, I would need to start all over. I can get into Fast Track, but my claim is gone, like I never even put it in. Sent IRIS an inquiry, and they sent it to the Houston RO. The Houston office stated that they would need to review my entire claims folder, that was over two weeks ago. Why would they move my claim from an electronic system to a snail system, and I know they can do whatever they want, but should I have not been notified first? Now, I do not know if I have a claim pending or not, very disturbing.

Does anyone have your POA?

I am concerned as to how you signed your VCAA letter electronically.

Did the VA send you a VCAA response form? It has election boxes on it.

"Why would they move my claim from an electronic system to a snail system"

For all the hoopla over the new fast track system and the IT screw ups-= still every claim needs the personal attention of an individual.

It isn't too late to seek a vet rep who might get more input on this.

A private lawyer has a partial POA for my NOD, and the DAV has the POA on other matters. In the Fast Track system there is an electronic VCAA letter with a box to check that indicates that you are signing this letter electronically. Also, it has another box that indicated it is a fully developed claim, and I checked that box. Since I have an NOD, a re-evaluation for PTSD, and Parkinson's that they decided to move the Parkinson's and put everything under the snail system? Maybe, if I had only the Parkinson's they would have left it under Fast Tracks, but I'm only speculating. How hard is it to change your VSO? BTW, thanks for the response.

When I filed for "S" the VA contacted my appeals lawyer. I think once you have a lawyer the VA is going to contact that person regarding anything you file. My issues were completely unrelated but the VA informed the lawyer anyway. I don't think you want split representation in my opinion. It will get confused. My VARO was very unused to dealing with a lawyer. It was good to see them squirm.

That is why I am so confused. I was under the impression that my when I hired my Attorney, his firm would handle everything, and the new POA that I signed with them would override the one from the DAV. When, I got this internal document, in error, from the VA they talked about the Attorney having only a partial POA. I need to get in touch with my Attorney and see what is going on. I'm very concerned about this Fast Track System, not only for myself, but others that used it, thinking their claims would be processed faster. How many claims besides mine were moved from this electronic system to the snail system without any notification? I pray for a simple claim, but it does not appear to be.
