Question

OK, in a nutshell, filed claim for IU in Oct09 at the Houston RO. By the time the C&P exams were scheduled I was living in WA state(long story). So, I was advised that I could move my claim from Houston to Seattle. Ignorant me thought that made sense and believed I was going to be living in WA for a significant amount of time. Fast Forward to current day.. living back in Texas) Claim is still open and I just learned from 800# that my claim just moved back to Houston as of 6July without me asking it to be. BUT my file shows to be checked out by an individual & going thru rating process. It seems to me Houston is moving it along now a lot faster than Seattle.

I didn't initiate moving it when I came back to Texas because I thought it would drag-out the process even longer. I also called DAV rep today at the Houston RO & she confirmed all I was told on the phone to be true.

ANY opinions or thoughts on this would really help me re-focus because right now I'm mentally & emotionally all over the place.

Ok, your claim is back in Houston in the rating stage, what exactly are you concerned about? Is it your worried about the fact you didn't execute the claim to be moved? Sorry if I missed something eagle-eye.

Just be very, very sure the VA knows where you have moved to recently. Try and stay put until you get your decision. When you move a lot the VA has a habit of sending important mail to old addresses. The USPS will forward your mail for one year. The more it has to be forwarded the better the chance of things getting screwed up. I mean if you need a C&P exam in two weeks the mail may not get to you for a month if it has to go through forwarding by the USPS. I think I would go to my VARO and make sure they have your correct address. The VA changed my address via a screw up and it caused me no end of trouble.

Good point Cooter, I don't know how to explain my thoughts on this. I just invision my file going to the bottom of the stack EVEN though I'm being told it's being reviewed currently. Not much faith with the process especially after reading how most of you guys have been yanked around.

Thanks John,

I have checked & double checked that VARO has my current address. Funny, there was a big, white envelope in the mail this afternoon. Looked very official. Unfortunately, that one is from the IRS-yuck!

Have you been on ebenefits lately to see if there is any updates on anything? Sometimes they'll send you a message also. I'm not much of a fan with the ebenefits site, but sometimes they come up with something interesting.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
