Question

Have you seen the latest shaft to Veterans taking place? Some Veterans were asked to go into some specialized MOSs and the VA offered to pay the Vets $10,000 after they finished the training and after they finish 3 more years of service in that specialized trainning they would get the second $10k. Everyone got their first $10k, but no one is getting the second payment. In fact, the VA now says the program was a mistake and they want their money back from the Vets.I guess there is 5 vets just in the State of oregon who this has happened to, but they know that this goes clear across the nation. And it entails several different specialized MOS in all services and are shortage MOSs.So like the song goes" The Times are a Changing!!" Theres no money for the current system of Veterans,so thats why they are not approving any new claims or additional benefits. Don't have to pay if no decision is made! Even if a budget is agreed upon, times are coming when they will reexamine any and all past, present and future claims. In the past, close decisions went to the Veteran. Soon, even the not so close claims will be losses for the Vets.I expect that soon all these different pensions disability,SSD, Federal and etc... will be either or and not both or all of the above. And the words "Justice for all" will be changed to" Proverty for all"!! The writing is on the wall,I don't know for sure, but I think it's in Chinese!! Mike

The funds are there - claims aren't being denied or not rated because VA doesn't have

the funds.

The sky's not falling !

People don't listen to it and don't be afraid.

Carlie passed away in November 2015 she is missed.

I have never heard of a program where the VA paid bonus money for soldiers or other military people to enlist or re-enlist in any MOS the Army, Navy, AF, Marines and CG pay their own bonuses that are authorized by DOD as far as I know the VA has never paid bonus money for MOS training or staying in a certain MOS for 3 years the VA has issues but paying DOD's bonuses is not one of them

I think those currently receiving those benefits will be grandfathered in, but younger vets may get screw job and NSC vets will get screwed first on medical care. Means testing is something we should not tolerate since it separates vets into "Welfare Vets" and 'Non Welfare Vets". I could not even get local VVA or any other VSO to just stand or sit in front of VARO with signs for an hour. I do fear that politicians will make vets choose between SSD and 100% VA. I already get screwed out of 60% of federal disability pension because I get SSD. SSA and SSD are already means tested since you get taxed on those benefits if you make more than some thousands of bucks in income. Means testing for medicare, VA compensation or SSA is betrayal.

Heres the whole story.I heard about it from my Congressmans Vet Rep. They are not afraid of Oregons Congress Critters. They have been blowing them off for months I see. I told him that they are no longer feared by their own government.Years ago they yeilded much power.Congress has lost all creditability with the people. The ones on the inside or outside.I gave up on mine about a month ago. They had no spine. Mike

So what does the VA have to do with this story? It was the National Guard that boned it

It's just another example of the mindset the government has towards its Vets. Whether they are current or past Vets, DENY has many meanings. DENY that we even exist! DENY that we are either sick or injured. DENY every benefit till we Die! Deny even when it's in writing that We(government) promised that.See, they even have you doing it.(DENY) The National Guard did it! Government is Government. Did someone Privatize the services and I missed it? Now is the time to use the Catch Phrase of 2011, " Follow the Money!!" They(pick a name) is coming to get the money promised back from the Veterans now. Soon They(pick a name) will be auditing your file, your life and will be holding out Their(pick a name) hands open to get back what they once PROMISED YOU! Are your promises from them(pick a name) any different than theirs were. Doesn't matter whos name is on the door when you got the money. If they want it back and you don't pay it, guess what the badge on the person collecting the money will have a different Dept. name than the one who gave you the money. " The Times they are a Changing!! ".Knock Knock, whose there? The Government."What do you want?" We want Our money Back! "I don't have your money"!! Yes you do, look in your wallet. "Thats my money, not yours". Look again, whose name is on it? "United States of America"! See I told you, it's OUR MONEY!! Next!!

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
