Can Not Get A Answer From The Va

In march of 2011 I filed a claim for 4 different issues, one was a had surgery on my ankle and filed for temp 100% and 3 other issues. On Oct 5 2011 I sent a IRIS request to find out the status of my claim and got a email form the IRIS, staying they had a back log of emails and had sent it to my local VA office and was waiting for a response from my local VA office to send to me, it is now the 15 Nov 2011 and no email from the IRIS, Is there some other way to find out other the 1 800 number, which I can not get a answer from. I have a been on the e benefits site and it just says it is in the development stage at this time. I had to go to my Local VA office in July 2011 because they lost the signature page on a document needed to complete my claim. I know it takes a long time to on a claim, I have done this before and my local office has lost my paper work before ( my file was lost for and i had to drive 150 miles to help them find it) just don't want to drive up to my local VA office again to solve the problem. also my American legion Rep is of no help, will not answer the phone or return a phone call. Thanks for all the help, yes what i meant my local office is the Regional Office, my claim was sent in march and had to go to the Regional Office to have a problem in paper work corrected in July. I work for the government and do know how slow things move in all government offices, just would like to know were my claim is. Thanks for all the help again. Thank Ken

Did you sent it certified mail, return receipt requested?

If you make that you policy in the future you will have proof that something was received. If you are submiting through the Legion, you will have precious little to prove that it was submitted. A vet who uses a service organization to turn in thier claim is entirely at the mercy of that organization, if somone throws it in a drawer and it is missed for months you didn't file for months.

Not trying to knock service organizations, If a vet isn't going to or can't commit to taking responsibility for the entire process they might be your best option.

So very true. It takes 3-5 weeks for any paper work I gave to the DAV before it was received by the VA. It was mailed from my town to phoenix DAV at the regional office where it sits in a black hole before the VA gets it., So now I send everything certified and have no one to blame but myself for any missed paperwork. We know it takes a while to go from the mail room at the VA before it is scanned into the system.

I send all my paper work, though my county VA office and they get conformation it was received, this helped me on my last claim, got a call from my Regional Office while I was at work and was ask what I wanted about my claim after I told them I was told I did not deserve the benefits I ask for, I got into a argument with that individual and all my claim got closed out that day with out my permission. I found out 3 month later and had to got to the Regional Office and got called told I had never filed the claim and they had not been closed out, I had my file from the county VA office and it had all the conformation numbers from each page they had relieved from me, they found file under a box that is all I could get out of them about it, all the claims got reopened that day and I got the % I ask for, just the dates where wrong off by about 8 months seance they had to reopen it with a new date ( had to do a appeal on that).       Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
