Berta
Yes, either I or someone else can help you....but I don't know what forum you need to post in. This topic above covers many subjects I think it is best to post your questions in the main Claims Research forum here and we can sort it out. By CID I assume you mean Criminal Investigation Command? By "agencies" is one of them the VA, for VA claims purposes? Edited March 16, 2015 by Berta
Berta
to add, I assume you have this most recent copy of the USACID Army Regulations. Also I assume but could be wrong, that you are still in the Army. Have you been assigned any type of casaulty liason officer, PEBLO or JAG? Not enough info here yet.....I am just guessing. 9 June 2014 Effective date: 9 July 2014 UNCLASSIFIED Criminal Investigation Criminal Investigation Activities Army Regulation 195-2http://www.apd.army.mil/jw2/xmldemo/r195_2/main.asp
Berta
"Instead of getting my brain the required medical care I received a field grade article 15, loss of all rank, loss of all pay, 45 days of extra duty and separated from the Army. I was just trying to treat my brain I had no help." A sole Article 15 usually never is the cause of VA trying to say a vet is not eligible for VA care. Did it cause you to have a bad paper discharge? What is the type of discharge you got?. Has VA ever questioned your eligibility to VA care......I dont think they did but I want to make sure... Due to FERES Doctrine you cannot sue the Army..... Due to VA Malpractice you can begin suit against the USA via the VA . But there is a statute of Limits. All of that info and also info on Section 1151 claims ( VA malpractice) can be filed with a FTCA case if still within SOL, and that info is all here in our 1151 and FTCA forums. "To this day the army review boards agency has neglected to see the neurosurgery consult and the referral to a neurosurgeon on both installations at Fort Gordon, Georgia and Fort Campbell, Kentucky." How do you know they have not seen it? Have you sent it to them yourself with priority mail? It will also be significant to any VA claim you are filing, as well as any MRIs CT scans etc etc. "Both installations had VA hospitals and there doctors failed to treat the chronic subdural hematomas to prevent further brain damage." You were a veteran at this time, right? Have you obtained all of those VA medical records? You are right, they should have done something to drain the hematomas.: http://neurosurgery.ucla.edu/body.cfm?id=1123&ref=25&action=detail Do you have MRI and CT scan results that are current as well as any older ones? Berta
for others willing to help this vet, this was from a pinned topic here: and doesn't seem to be appearing in the current main Claims Research Forum for some reason.
