Question

I WOULD LIKE TO KNOW IF A FILE THATS WAITING FOR A BVA HEARING

CAN THE LOCAL VA THE LOCAL VARO CHANGE THEIR MIND AND PAY THE CLAIM FOR THE RETRO

OR

ONCE YOUR HEADED TO THE BVA YOUR NOT COMING BACK TO THE VARO UNTIL AFTER THE BVA??

THOUGHT I HEARD OR SAW A POST HERE THAT A LOCAL VARO RE CALLED THE FILE FROM THE BVA

AND PAID THE CLAIM

ANY TRUTH TO THAT??

I took up a veterans case that had an appeal before the BVA for an increase in his PTSD. I was able to work the claim at the VARO in showing the RO some errors made, they changed the rating from 30% to 70% and asked if the veteran to with drew the appeal for it to take affect.

You file is at the RO for them to work it until the BVA is ready for it. I have read cases where the VA said they wanted to work the cases and it was just sent back. It happened to a claim I did when I sent in something from the veterans file that the VA never saw. The BVA hearing was not pushed out to a date yet not known. the vet was granted SC at 100% for PTSD and some other things.
