Va Dental

VA rating 70%. USAF Retired in 1996 after 21years w/periodontal and box 17 of DD Form 214 is checked no. That's the box asking if dental care was provided in the last 90 days of service.

Recently found my full mouth x-rays and treament records from 1995 confirming periodontal. I feel I should have been provided continued treatment since this appears to be service connected (in the dental records while on active duty), but was not advised at retirement.

I read the VA thig about no compensation for periodontal and not seeking that. Would like to know if VA should/will provide treatment in light of these facts. I feel that the dental clinic should have instructed me on this at retirement. Any thoughts from folks experienced in this are appreciated?

PS I'm not an E-2 nor a seaman as the icon to the left suggest, but have no idea how to change that stuff. Alos, tried to start a new topic since one for VA Dental does not exist, but all I can do is start a new post.

That is a long time to now claim that you should have been provided these benefits........IMO, your fight over this will be up-hill at best and the answer will be NO......But hey, it's the VA so ya just never know.

PS......The Icon is based on the number of post, not which branch or rank you had upon service time

Relpats:

There are two issues:

1. Service connection and compensation for your teeth problem. You can apply for benefits based on this. Assuming an honorable discharge and no "willful misconduct", you need to show these 3 things to get service connection.

a. Current diagnosis. If you have problems with your teeth, then your dentist can make a dx.

b. In service "event or stressor". Sounds like an x ray should suffice.

c. A nexus between the two. A doc or dentist would have to supply this opinion.

2. Medical treatment (dental). You can apply for treatment at your VAMC, if they have dental.

If you are denied, like most are, you can appeal.

Sure, go for TDIU (100%) SC. Then you will have all Dental.

Getting Dental Connection was hard for me. I have 5 teeth connected. Seemed like each tooth was a separate case. Even with these teeth connected there is no %, just a notation that Dental will take care of this and that.

PS Forgot to say even before I hit 100 al least 3 of these teeth were already connected. Any time something happened to one of these teeth the VA dental would work on that tooth.

My front bridge, which was DoD paid for to my private dental, became bad years later (15 years). The Bridge was remade by VA Dental no questions asked.

Answers:

JR Reihs- VA Briefer at retirement said not to expect anything from VA so no one in the room filled out any paperwork...two years ago found out we could expect something from VA and since rated @ 70%, go figure.

broncovet- Honorable discharge at retirement, no misconduct. VA says no comp for periodonta. I just want treament. Yes have SMR's and x-rays.

We all have some things told to us and alot of things NOT told to us that they should have..........you are at 70%, shoot for the 100 or IU as was said and you will get dental.......it really sucks, but you got to play by their rules.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
