How Would You Handle This Situation?

Question

Good evening! Yesterday I was feeling terrible so I went to the VA E.R. I was experiencing extreme dizziness, fatigue and the terrible head aches, pain and numbness was effecting me bad. Shooting pain from both feet alternating- Even fell out of bed. So, the VA gave me a shot of something and a pill. Even fell out of the hospital bed there. They booted me out like a dog. I even explained that I had a brain tumor-they didn't care. I informed patient advocate as well. Nada-no big deal. My discharge paper work for the VA previously stated if symptoms re-appear or get worse, return to the E.R. Per original doctor I was to remain in hospital till surgery. For what-they surely didn't treat me right. And I have surgery next Thursday? My head is killing from the pain. I called nero surgery and they they told me the doctors in the E.R. know what they are doing. If they have any questions they can call us! Damm! What crappy health care is this. I have the surgery next week and surely don't trust them. They couldn't even diagnose me properly. I want the whole nation to know about this VA Health Care in Tucson!!!! I need a list of folks that I can call tomorrow to expedite this 1st thing-need to open a can of you know what ASAP!!!!!
Why should I suffer in pain, And the patient advocate-worthless!

I've seen many veterans complain to the patient advocate to no avail. I've also seen them attempt to obtain an appointment with the hospital director. Many directors will not see a veteran with a complaint, they need to go to the patient advocate. I don't believe that you're the lone ranger here. Its a sad situation for us veterans. The good thing, its not like that everywhere. I'm really not sure what type of advice to give. Even with a congressional complaint, the VA has become numb. Again, I'm not sure what is happening, but I do know this for sure, we need new leadership at the veterans administration. I don't believe anything will change until that happens..

Sometimes I wonder if the power of the media could ever be of help here. Kind of like a sting operation. Of course even with that it is only the stories that can make some individual money stay in the lime light.

I don't think that you should have to brother. If I knew a way I would surely tell you how to get this fixed. Okay in a way as a remark and a question. Since at times VA health care is so subpar, can fee based care be utilized to mitigate some of the ill treatment?

I have started to ramp up the fight. I posted this on the local VA health care site, tomorrow I call the director. Later, the Congressman's office. They are playing with the wrong person! I am a founder of a military face book group with 5800 members it-they are aware!

Sorry to hear what you are going thru my friend. I remember when I had a supposedly routine Tonsils taken out a few years, and a Active Nose Doc did the surgery, instead of a Active Throat Doc. What happened surgery was screwed up, and a few days later I had to have Emergency Surgery and a Blood Transfusion, WTH! I actually have a 10% Disability for Loss of Taste due to the VA acknowledging this was a in their words "Botched Surgery". You never know with the Dang VA

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
