Retired Navy-

Hearing Loss with aids-0%

Tinnitus-Denied

Back problems (4 items) 4 Vicodin a day, 2 30 mg morphine and 2 hr bed rest-denied

Crushed hand in navy-10%

Deviated Septum Navy with surgery (Tripler Army-Denied

Hypertension-Meds issued by VA- Denied

bad left ankle, broke before navy but was aggravated during service-Denied

Mental problem with amount of drugs- VA Counselor Depression

What am I doing wrong?

Any help?

They keep flooding me with paperwork and cannot keep up.

In order for a VA claim to be approved, it generally has to have three parts.

Part one --something happened in service. In your medical records you would have an event, symptoms, treatment or a diagnosis of an issue.

Part two-- Something is bothering you right now. You are currently undergoing treatment for an issue or have a diagnosis of a current issue.

Part three--a Dr. can tie parts part 1 & part 2 together. This is called a Nexus statement. An example would look something like this, " The veterans deviated septum -incurred in service- more likely than not caused his obstructive sleep apnea." This can come from either a VA doctor or a private doctor.

For most direct service connection claims you will need all three of these parts for an approval. If your claim is secondary or presumptive then the rules are a little bit different.


What stage is your claim in right now?

If you do not have a copy of your Service Medical Records (SMRs or STRs) that is the first thing you need to get. If you do have a copy of your SMRs, then you need to read through them and find the notes for things that happened while in service.

To have a claim service connected for compensation, you need to complete the triangle set forth by the VA.

1. Must have documented incident in service medical records.

2. Must have a current diagnosis by a physician.

3. To complete the triangle one the following must happen:

a. Disease or incident must be considered chronic in nature

b. Veteran must be able to show continuity of car since leaving service.

c. Veteran can get nexus letter showing connection between current situation and military duty.
