0 Berta
"I was going to write a letter to the RO about the date but I don't want to rock the boat." Many of us have had to rock the boat. You said the VSO recently faxed the claim in for you, so, did he fax them the original claim you filed? "I still haven't been told what happened to the original paperwork." A copy of whatever he faxed in ,should be in the POA file he has on you. From May 2014 to Jan 2015 did you receive any acknowledgement at all from the RO via 800# or IRIS? We have to be proactive with our claims and their status , regardless of what a vet rep does or says they did. Maybe this will help others out there who use their PC printer fax machine, I stopped using my personal fax machine. I use instead FaxZero, a free service on the internet.. That way I get a confirmation from Fax Zero in email that what I sent and when and where I sent it , was actually received. There might be a charge for adding lots of attachments to the fax but this was the only way I was sure VA got faxes I sent them in the past. You need to see your POA file. You could even ask for a copy of it. Did you get a VCAA letter in 2014 for the claim? That in itself would prove a claim had been filed.
0 HadIt.com Elder Buck52 Posted February 28, 2015 HadIt.com Elder Share Posted February 28, 2015 (edited) I agree with Ms Berta Make sure your VSO File the claim May 14th, remember to always get a certified stamp ''dated'' copy of the claim especially if your VSO filed it. (The VSO can stamp it) if you had that then that's your proof. I don't trust VSO myself because no matter what they do it always falls back on you the veteran. Yes when you get a decision they should have attached NOD form for you to file...check the EED and if its like you mention above disagree with them. if they don't you can download one or just send them a letter stating you disagree with the EED on this particular claim....do it even if the claim was expedited! Always get sign return receipt Always anything you send the VA. With that said you need a copy of the claim you filed on May 14th as to your evidence for your EED. (Earliest Effected Date) or the VCAA Letter as Ms Berta mention. Keep all correspondence from the VA and you & your rep in a safe place...it could come in handy someday. Buck! One thing that is almost certain: If there is a scandal at one Regional Office or Medical Center, you can almost be assured its happening at many of the others, too. VA will likely deny this, but we
