21 Million Malpractice Settlement Va

Berta

Question

"The United States was recently ordered to pay over $21 million to a veteran and his wife for damages from medical malpractice that led to a second stroke Veterans Affairs doctors failed to prevent. The victim, veteran Michael Farley, was 78 years old and the funds will pay for the remainder of his care until his death."

Thsi is one reason why I continue to aggressovely fight the `1151 Stroke my husband had, that contributed to his death.

Very few veterans have direct service connectable strokes, (I think Chesty Puller did but the VA gave him all sorts of problems and usually VA only SCs a stroke as a secondary to an established SC heart disease or diabetes, with a strong IMO.

Very few claims like that...VA does not know how to properly treat strokes at all.

GRADUATE ! Nov 2nd 2007 American Military University !

When thousands of Americans faced annihilation in the 1800s Chief

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

Which Costs less, Aspirin or Warfarin.

Aspirin is likely cheaper. There may have been an unofficial local cost saving policy in play.

Warfarin use requires fairly frequent lab tests of clotting,

dosage monitoring, etc. ($$$) (Along with likely dosage changes as time progresses.)

Warfarin ("as I've been told") can cause minor injuries that involved bleeding to be very serious, due to

Blood loss. I remember some minor surgery I had some years back. When the surgeon looked

at my prescribed drug list, he told his nurse to break out a surgical dressing pack that was used to stem massive bleeding.

(It was unneeded) Both of us were surprised that bleeding from the site was minimal, and there was little or no evidence

of a problem. I was actually a bit concerned that there was so little bleeding.

The only visible sign of the drug effects was (and is) that scabbing is much darker that it would be without the drugs.

(Almost black instead of a red brown)

For over a decade, my private cardiologist has preferred to use a drug combination which includes aspirin instead of warfarin.

This is in spite of some of the general guidelines mentioned in the court case. They had an either or/ both set of choices that did not

deal with other possible alternative combinations on the VA's pharmacopoeia.

I believe the va montra is ... CHRONIC DISEASES SHALL ONLY RECIEVE ACUTE CARE.

Here is what im seeing.. The primary care doc, who is usually a internal medicine doc, is the holder of the keys of treatment in the VA.. EVERYTHING has to go thru the primary.. If your primary is playing company man, then you will not get the referrals or examinations and tests needed to keep you healthy. If your primary starts squirming when you ask to see a specialist, and he wont refer you, and cant him or herself explain to you what is wrong with you, you may be getting denied care. I think many times, the VAMC doesnt even have the specialist required on staff, and we all know that getting referred to outside doctors is a BIG no no, in VA land.

Lets do a little asessment.. Ok VAMC should be the cats meow for doctors to be employed at.. They dont have to keep insurance, which is super expensive in the civillain sector, they dont have to be licensed. AND they cant be sued.. AND they can make close to 200 k a year with a handsome benifits and retirement package..!!!(im sure surgeons make alot more)

Break out the balloons and chablis,,, IM GOING WORK FOR THE VAMC.. YEAHHHHH!!!

Then when they get there, they realize that it is a politically run system, and the vets are not priority,, The docs must either " conform" to thier ways, and often break thier oath, or quit.. That is the reason for a doctor shortage at the VA.. Professional, caring doctors find it a hard pill to swallow shafting veterans..

this is my personal opinion.

Manchester VA has been a problem for yrs. I believe it is no longer a VA hospital but does still see vets in their so-called ER. I'd never go there, again. Their Veterans Service Center(VSC) is worse. My original appeal started there (until I switched to VT) and was denied for about five yrs. The VSC manager retired, around the mid nineties, and went to work for one of the service orgs, where he was able to win all the claims, because he'd been denying them, for yrs.
