C&p Done By My Dr. ( Need Help....) On Rom Degrees

I have a rating of 40% for degenerative bone Disease in my elbow they trying to change to 10% . I Did a C&p from my physician also yesterday to take to my hearing. on the ROM for Flexion he check the box "Not indicated" and on Extension he wrote 160 degrees, forearm Supination he checked "not able to perform", forearm pronation he wrote" minimal"..... Is this good or bad. Thanks

So far I haven't been able to come across the SC Reduction of 1 step down info. Maybe I was dreaming.

While reviewing the VA M21-1MR regarding Adverse Decisions, I see that I was somewhat premature in advising regarding filing a NOD right away. No Decision has actually been made yet, so you can't NOD it. You said you requested a Hearing right away, good move. Have you been advised of your Hearing Date?

The Reg did state that if your NOD were received during the last 10 days of the 60 Day Intent to Reduce period, it would be considered to be a timely filed NOD. The important point stressed in the Reg was that "NEW" Medical Evidence supporting your claim, must accompany your NOD.

If you get the Hearing, great, but be ready with your NOD and file it on the 51st day. Without a favorable Hearing Decision or your NOD with New Medical Evidence being timely filed, on the 65th day after the Date of the VA Notice to reduce, it will take effect.

You could get a referral from your VA PC DR for VA Physical Rehab or the Pain Management Dept. PR Dept will check you out and complete a ROM Report that hopefully, would contradict your recent C&P. Maybe get you to a "Benefit of Doubt" situation.
