JP-5

Question

I am fighting the VA right now on the fact of Jp-5 ingestion while aboard the USS Saratoga cv-60. we were forced to drink freshwater laden with Jp-5 fuel. From what i have found out so far is that jet fuel dumped under the ship to be dispose of, as soon as it went into the ocean it was pickup by an aft intake tube that brought sea water in to be turned in freshwater, desalinated. it was in the drinking water( remember bug juice)?, showers, food, etc. you tasted it constantly and felt as well. this happened aboard all forrestal class carriers, and believe me i have statements from hundreds and hundreds of sailors that all remember it as well. if you have or know of any of this happening please email me or post here to read, i m running out of time with the VA.

What exactly are you attempting to SC to your exposure to JP-5? Do you have a current DX that your attempting to link as "More Likely Than Not 50%+ Greater probability" was cause by JP-5 exposure.

Your "Running out of time with the VA?" Do you have a Terminal DX?

More Info, is always better than less.

I had dx for jp-4 exposure, and have sc for that... am fighting for other chemicals at this time, should have my appeals decision at any time, but took many, many years...

Gastone, above, asked the best questions...

does your medical service records have any illness or injury, or have any after discharge that you think are linked...

I have fought similar injuries for many years, you need a paper trail...

Not in appeals, since I got 100%, and some of it was winning an 1151 negligence, which the VA turns out does not give ful benefits if you win 1151 negligence they squirm and legal loophhole you and your family out of many benefits, really crapp nasty bunch running the va benefits, they wil backstab and scre wyou even if you win you lose. I don't have a paper trail because since 2001 they have never been able to find my military records. they have told be many, many times that they think my records were burned up in a fire at the storage place (I think St. Louis) where they would have kept my records. i have had a local congressman and then a senator tried to request these records as well, they also were told of the fire. found out that I was not the only one to lose my records in this so called fire even if they found them now and my medical pages were missing it wouldn't surprise me, they have done a lot of other unethical things in history. when i got off of active duty in 1979 i was to report to Pomona Calif to fulfill my two year comment of active reserves( one weekend an month and a two week stint on a ship). the day i checked off the USS Saratoga they handed me my records that i normally would have kept forever however, they had me hand them over to the reserve center the first time i checked in. never saw them again. I do thank god have a copy of my DD-214 to show i did my time. I don't have a lot or know of the things you were talking about. I was told by a ship board Dept. head Medical Officer (the head officer) as well as an report from an on base medical hospital on base that someday I would more then likely have kidney failure( from other medical personnel they stated everyone on board the ship knew of the JP-5 in the freshwater situation that existed anytime we were out to sea, it was at the time a hush hush situation, I WAS AROUND JP-5 ALL THE TIME) also there is absolutely no kidney problems any where else in my family. i started getting real sick and went to the sick bay quite a few times or a lot. I have a lot of testimony from hundreds and hundreds of sailors that serve on all 4 forrestal class carriers. i know it's easy to say my chances are slim but i have to move forward on this. I got out and 10 years later I had my first total kidney failure, two kidney transplant and open heart surgery from all the med's that i have had to take. Look I know that I'm probably going to lose this but i have to try because I did my time and now I'm paying the price. Just look at the situation with the asbestos situation, at first the the VA did what they do best and that they turned down all the first sailors that started making claims, and since then so much evidence came forward and the media made it a big case that now they advertise that they want to know if you think you were exposed to it and approving you. convenient I guess that so many sailors had to die not knowing that help was coming, very convenient  for the VA right. since i went in at 17 1/2 and i was 20 when i got off active duty and then 2 years active reserves not inactive reserves .  I started this 10 years later but my kidneys started failing a few years before that ten years. I always say lets just take some unsuspecting soles and supply proven JP-5 in the freshwater(drinking water, showers really bad slim on you all the time, in the food and the cooks know of this as well, and that they really used a lot of BUG JUICE to hide the smell and taste. I know you guys are going to read me a new one but i still have to do what I think is right. You would be surprised how many other sailors from the ships that now are talking about their own issues.  Any advice You can give me "not just give it up" would be really appreciate it a lot, thanks  I was there in case we got into any conflicts and did my time. whats fair is fair. I think their just hoping we just go away. I know you're going to tell  me that I have no case. Have a nice day to all.

I was in the Navy from 1976 -1982 and i tried to get my records from medical and they say their gone also. when i went to the on base hospital from a referral from sick bay on the ship they say that those records would be sent back to the dept head on the sara, of course their gone also. like i said i think in this discussion a congressman and senator all requested my records also and the gov stated the same thing to them as well, they lost them cant find them. its been so long now even if they said they found my records and my medical stuff was missing i won't believe them, sorry

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
