Question

I use to do work study in san diego, so with that your claim goes to LA, (one of the worse places to have your claim) Anyway i put in for an increase for my left shoulder and a new claim for right shoulder secondary. Anyway when i call the 800 number, they can't see any new claims for me in the system, but when i go to the DAV and they look in the system, they tell me that my claim is being worked on and how somebody look at it a few days ago.

My question is? Is the d.a.v guys lying to me, or maybe since i use to work for the va and i have a sensitive file the 800 folks can't see whats going on. I need some help with this. I would hate to not have an open claim pending.

did your DAV SO give you a copy of the round dated submission form? If not then ask them for a print screen showing it in the system if they can't produce it and you lose the months they have been screwing around I would be filing a claim against the DAV for the lost compensation Berta can tell you how it's done no copies usually means they haven't done it

The AL left mine laying in a file cabinet from July 03 until Dec 03 when I asked to see the file copy and all the oroginal paperwork was laying there, no NOD on heart problems and no initial file for PTSD I lost 6 months of compensation at the 100% rate do the math about 15,000

100% SC P&T PTSD 100% CAD 10% Hypertension and A&A = SMC L, SSD

If any vet rep or service officer causes a vet monetary damages, they can be sued for negligence in state courts.

My former vet rep never sent the VARO my claims or anything else in 2 1/2 years.

I had sent all this myself too- good thing-

My POA at the RO level didnt even know they represented me during the first DRO review-

I send everything Priority with tracking slip and I print out the USPS confirmation when the RO receives it.

Certified mail can also be tracked on line at the USPS.

My new vet rep has emailed me that he did this and that in last 2 weeks regarding my inquiry response (they said they never got my IMOS- sent many times, and they even came back with the remand, Also the POA claims they presented these to RO too-)

yet the reality is- I asked for hard copy to confirm what the POA has as to the latest status of these IMOs and I have gotten nothing back from them at all--just CTA stuff (cover their a-- stuff)

I suggest that you call 800# again and make sure they check the COVER screen- this shows the physical presence of the c file and confirmation of any claims they get.

If the VARO still says it isn't there- time to put the squeeze on the rep for some answers.

Most claimants would go berserk at this point- the IMOS have been submitted numerous times- but I whipped a copy of the inquiry out to the Regional counsel -"mosh kosh"-

old Marine talk for lickity split-because the VA inquiry statement supported my recent property damage claim! Whoop ti do- I love it when they perform oral pediatrics-

putting their own feet in their mouths)

PS -My husband was a VA employee -too- and they marked his c file a special way-

this caused him great problems when he tried to get a real PTSD shrink-

I dont know if it affected the way his claim was handled.

If the evidence I am going to submit to the VA is really important (IMO's, medical records etc.) I drive over to the VARO and I get it hand stamped as received. I trust neither the VA or my VSO to do the right thing. The VA does throw away evidence and claims because they have done it to me before and even admitted it.

A big VARO's mail room is a mess. They get thousands of letters every day. They seem to do better if a official VA form is attached to what every you send them. I use the Statement in Support of Claim as a cover sheet.

I agree on that form John- the 21-4138-available at the VA web site-

I thought for years my POA had sent these in- but the first one they ever sent was a few months ago-

I think too that this form triggers their attention-

If I have to send in my IMOs -AGAIN -I will use this form and print the IMos on pink and chartruese paper.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
