Rated at 80% but i have questions... Pics attached

Question

 Am I rated for PTSD? I was able to find records during my service to support my claim and also from the VA healthcare to support PTSD but im not sure if I should re-open my case?

I have an MST and also found docs to substantiate some of my other claims but im afraid I might lower my current rating.. Any help would be appreciated... Can I appeal my current ratings? 1.jpg2.jpg

However, you with a raw 84, would only need a 10% increase to get you rounded up to 90, so, not so hard, and there is where the train slows way down.  You would have a raw 86 and would need a new 70% or an increase of 70% to get to 96 rounded to 100%.  Look at some of your other ailments and see if they have worsened or have contributed to a new disability.  Claim as secondary, etc.

I am currently at 80%, raw 81.  At a minimum, I need two 10% increases bilateral to get me to 90.  There is where it will stall out for me as the highest single rating I have is 30%.  And there is no new 70%er in my future.  But it is what it is.  I claimed and will claim what I think I deserve and no more.

I thought that 95 was rounded up to 100?

It will definitely be a tough road but I think that things are getting a little worse and when I went into my C&P exams I had never even heard of this site or read half of the information I have been reading in the past couple days. My VSO found like 5 or 6 claims that were not service connected and I have my records and can resubmit those and that should start to get me down the right path.

Im just so thankful for all the information I am finding on this site. It sucks not being able to play with my kids and being in pain or on meds all the time for it or my mood. Its terrible. Its hard to say what I think is a fair number or what I deserve but I definitely got xxxxxx up in service.. smh.

I believe a MST Claim is also a claim for PTSD if your symptoms has worsen since your last rating /Doc states that it has worsen ....you bet file for increase.

Another thing to is

What you can do is look at  the secondary's caused form PTSD/Medications

if you have any other conditions that has manifested from taking the PTSD Meds  then you can file a claim as secondary to PTSD/Medications

few examples

OSA can be related to PTSD Medications as a secondary condition, you need a diagnose for Sleep Apnea and prescribe a C-PAP Machine from the VA and the Dr states its likey as not that the  PRESCRIBE PTSD  MEDICATIONS you take are related to your PTSD   =50% & lay statement from spouse would help.

ED can be related to PTSD Medications, Urology Doc to state that the medication you take prescribe by the VA is likely as not caused/related to  your ED and name the medications and give his credentials as to render his opinion & you do this with a private IME ..The doc will need to read your pertinent medical records and examine you. =10% but I think they rate the ED  secondary as 0% but it would be Service Connected But not direct S.C.....However at 0% ED Service Connected  it warrants a 103.** $$ monthly income with what ever you get compensation on now.

They are other conditions that PTSD Meds can be related to if you have any other conditions that has manifested since taking the PTSD Meds  then you might think about  finding out if they can be S.C. Secondary to your PTSD/Medications  ect,,,ect,,, & filie claims for those conditions.

IF you have 3 or more 0% Service connections  that warrants a 10% Added into your existing ratings

But say you do get a Diagnose for OSA (S.A.)  THE 50% WOULD BRING YOU UP TO 96% rounded to 100%

There's been Veterans file claims for S.A. secondary to their PTSD and awarded 100% rating   depending on the severity of the S.A....When this happens  its an invite to the SMC-S or brings a Mandatory SMC Rating.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
