Question

This whole SSA is almost as confusing as the VA is I just proved I was P and T with them now I just had to sit through two denials a reconsider and the first claim before I filed for a hearing on July 26, 2017. Its just like the VA with this wait I was told 18-20 months with a wait. Who knows my attorneys seems not the brightest I got my claim expedited by having an inquiry made by an inquiry made on my VA rating of P and T. Not sure what that does I check last week and it was in some sort of pre hearing phase before the hearing but I'm sure if their like the VA delay hope something happens wait some more nothings happening wait some more of remand back to the BVA. Has anyone had their claim expedited on their rating of P and T while waiting?

P/T is supposed to Expedite however really has no controlling weight on decision, actually the only thing that has any controlling weight by rule of law is what SSA see's it in there eyes to be. Remember it's not like the VA it is an Insurance claim that you actually are filing for. I like to think of it as that way, have you ever heard or dealt with filing a insurance claim in general.. yeah.. they don't just hand out money easily .. like SSA. Now SSA will and has to pay up when there is so much convincing evidence according to there "guidelines" we are all bound by there ins guidelines no matter what the ailment is, pretty sad but in reality. Best advice i can give is be ready, if you know there is any inconsistency or double in your medical charts.. you better square that away Marine!! because SSA does no like inconsistency or Double it's either fluid or not.. if its even a bit murky.. The red sirens go off at the round table. Also, your Doctor has to be in it together with you!!! ride or die or its a unfortunate dilemma.

Another best advise i can give ya is make sure you know when your insurance coverage end of life is or it will smack you in the face so hard. If you have an attorney ask him if he knows the judge! if he does not, he is probably a rookie, also ask him if he is linked up with SSA in the account to actually see things go across the channels, if he does not.. he is rookie monster. Don't be that guy that could take on your Lawyer at a bar exam, if that would be the case then your better off riding solo.

Take it from me get a NEXUS by a specialist stating you cannot go back to work. SSDI tried twice, first the initial hearing to deny me but I won because the VA purposely tried to hide the EMG reports by not sending them to the VA. Luckily I had everything at the SSDI hearing in front of the judge. This was in Jan 2014 then in Feb 2015 they sent me a letter they are "reviewing my case"..Again I had to get a specialist to do an exam and write a letter. This time around I was found to be P&T with SSDI because if they say no future exams schedule then its permanent. Then I used that letter just this year to have the VA approve me for P&T. The VA had no choice because SSDI found my issues to be only Service Connected issues so the VA had to give me P&T. I am on high levels of pain medications, I hate them so much, but without them the pain would be too much.

Don't give up, get a specialists to prove your issues. It will cost you but in the long run it pays for itself.

Update hearing scheduled for December 19th 2017 apparently I missed a day when checking the status so I don't forget my password but logged in this morning and this is whats shows. It has the address and I was wondering is it to soon to find out what judge is scheduled for my hearing? My attorneys  were just last week said I had about 18-20 months before it scheduled I want to hear there response the only thing I did was talk to a congressman/senator with my wife who put in an inquiry about my VA P and T rating to get my hearing expedited hope that's what did it my attorneys were clueless last week Im sure they are fine I'm using Mylar disability they did all the paperwork side I never would have been able to figure out. So now I have 4 months of waiting that's almost as bad as knowing the day your returning back from deployment counting down the days.

Sadly I have issues when i speak and can not get my ideas out without constant pauses and delays as the thoughts come and go to quickly and I stutter when I'm nervous. My psychiatrist says at times she feels as if she is talking to a child or a 3 year old, I feel like I'm being body shamed from the mouth. Whether it would help my case or not I would rather keep it to a minimum of speaking with an attorney helping me out and can you please explain the life insurance thing I think it's about time I've set something up...
