63Charlie Posted December 21, 2018 Share Posted December 21, 2018 Two weeks ago, I was provided a C&P exam by LHI for Meniere's Syndrome. My attorney is unable to see the DBQ from that exam on VBMS. Yesterday, I receive a call from the Viera CBOC to schedule me for another exam for Meniere's Syndrome. I'm feeling that the first examiner's opinion was favorable to establish service connection. I'm feeling that a rater is seeking a negative opinion to develop a denial of my claim. They already pulled this stunt on me once before on my ankle condition. Had a favorable C&P exam and the rater didn't like it so I was sent for another exam and the rater found the negative opinion "more persuasive". Ship of fools. WE CAN'T GO BY OUR FEELINGS OR WHAT WE THINK. ..WAIT UNTIL YOU GET A DECISION.. OR IF YOU GO TO THIS OTHER C&P EXAM...YOU MAY NOT GET THE SAME EXAMINER, OR IF YOU DO THE EXAMINER MAY NEED TO RE-LOOK AT YOUR 1ST EXAM ABOUT SOMETHING HE FOUND..IT COULD GO AGAINST YOU OR FOR YOU? OR SOMETHING YOU CAN STRAIGHTEN OUT THEY NEED TO KNOW ABOUT. USUALLY IT WILL GO FOR YOU...BUT LIKE THE OTHERS HAVE MENTION IF YOU FAIL TO SHOW UP FOR THIS EXAM 90% CHANCE YOU WILL BE DENIED THE WHOLE 9 YARDS. Sorry for the Caps just now seen this oh well you can read it...I'm not mad or anything like that...hope you C&P is more favorable than you thought. 0 63Charlie Posted December 23, 2018 Author Share Posted December 23, 2018 JUST ANOTHER INADEQUATE C&P EXAM Attorney informed me that the NP opinion was unfavorable to establish service connection. Attorney said that the NP failed to provide a diagnosis of MD, AND, that the NP failed to address relevant symptoms for the MD condition, as noted in the STR evidence. SOS, different day. I told the VA scheduler, Viera CBOC, I was unable to attend another exam at the present having almost died of a gangrenous gall bladder last week, and am still suffering from the residuals of surgery.
