Question

I recently posted on here my confusion about appealing an EED to VBA or HLR. My VSO had me submit an appeal with a HLR. In case anyone is interested in how that process is going for me, here's where I'm at.

Submitted HLR received August 7th
HLR made decision September 19 (claim closed temporarily)
VA identified an error September 19
Veterans Benefits Administration is correcting an error September 22 (New status)

The HLR did make a change to one of my EED appeals (I have two that I'm claiming for a EED).  HLR changed it from 1/30/2019 to 1/13/2016. Retro pay hit my account today.

I'm sure I will receive some details on the decision in the mail and hopefully what the error is. I called Peggy Friday and they just said I'll get the decision in the mail and they couldn't tell me anything over the phone.

Thanks @GeekySquid  I felt like I was losing my mind for awhile just trying to get someone, anyone to look at the EED and see what I was seeing, so this was a big win for me. Looks like I may still be in for a uphill battle with the other EED but just to get one done made my day.

that you got one set of retro already is a big win. glad they did not tie it up longer with this remaining issue. hopefully it will go quickly an bring you in a few more ducats.

This brings up a separate question. How often will the VA decide and grant some, but not decide the rest of a multiple disability claim. I don't mean a court and remand decision situation, but say actually grant 1 or 2 claims and still keep the other 1 or 2 open?

va keeps that data secret....damn squirrels when it comes to useful facts.

Well, I am sure it is only for our own good to keep that kind of info away from us. I mean, after all, they ARE veteran friendly and always have the veterans' best interests at heart! Right?

To answer your question, I had a DRO award 100% for "bent brain syndrome", and not decide any of my other conditions on appeal.

Been in appeal since early 2016 and not a single condition, thus far, has been made it to the desk of a Veterans Law Judge.

I’m in the exact same boat as you. My messages are identical with the exception of dates which are only a few days off.

Keep an eye on Ebenefits as it updates pretty quickly (at least in my dealings). Either check out the disabilities or use the letter generator.

Good luck!

No. I have received no information at all. A while back my status was changed to decision letter sent. When I didn’t receive it after two weeks I called and they said that no letter was ever sent. I have received no information at all. Every time I call the veterans benefits administration I get the runaround and each time I’m told something different.

I still check Ebenefits and VA.gov every day though just to make myself nuts.

Did you say you already received back pay?

Yes, the early effective date was changed on one of my issues last week and Monday my back pay hit my bank account.  I checked Ebenefits and  it was changed from 1/30/2019 to 1/13/2016.

My HLR claim looks like same except that during my informal conference the lady identified that an exam had been missed. So one of my issues was decided (increased) that day and they requested an exam (that what the error). I had my exam and it still says they are vising an error.

My timeline is:

Submitted HLR: 5 July

Informal Conference: 5 Aug

Increase/fixing error: 8 Aug

had exam on 30 Aug (it doesn't show this anywhere on va.gov)

When I call the 1800 number they tell me it's in the decision phase.

Hello everyone my status is the same as well except the dates, but they are not to far apart as well.  I am wondering if someone can help me understand what's going with my claim for PTSD/mst personal assault.

So I am currently in a high level review appeal. My status on my appeal says va is correcting and error.

Appeal received on 08/22/2019

Va appeal closed(temporarily) on 10/04/2019

Check back on 10/07/2019 Va made a new decision 10/04/2019

Va is correcting an error 10/04/2019

When I called Peggy they say to wait on a letter but did give me a little detail in regards to what the letter stated. It states something about a 5103 form and mst restricted report DOD.

Can someone tell me what to think of it.

I’m in the same boat. Peggy always says that at first. Your HLR is still working if it says VA is correcting an error. If you call Peggy, ask what your current status is. Use that verbiage. Have them break down each disability.
Mine has been at VA correcting an error since Sept 3.
Good luck and keep us up to date on status/ results.

"tell me what to think"

I had this occur but I didn't look online until after I got the retro/percentage changed and letter in the mail. For me it was % change on one of my claims but no retro. So basically it is being worked on right now and you will get your answer any day now, around 3 weeks to get.
