VA found an error in their duty to assist

Rate this question

Question

I just received a letter regarding a higher level review that says the VA has found an error in their duty to assist.  Has anyone else ever receive that letter? If so, how’d yours turn out? I have received many letters from the VA but nothing like that one.

Still waiting patiently…

July 26 is when it was submitted and got an update Sept 3.

Wow, that's pretty quick. I called the VA toll free number recently and asked them how long HLR took. They said it could be between 125 days to 12 months.

It sounds like an open and shut case of ebenefititis.

ebenefititis..def.  A condition where Veterans who have applied for benefits tend to believe ebenefits which is known to be unreliable.

This mental health condition should be Service connected, as it is caused directly through exceptional long, frustrating delays and glitches in Vets benefits.

So far, there is no cure for ebenefititis, other than, of course, daily hadit readings.

ebenefititis. Ha!  Thumbitis is real after the Nintendo NES came out and can be cured by not playing video games.

You are gonna have to wait and stop checking ebeney multiply times a day. Once a week on Thursday will suffice.

All this time you spend on ebennies could have been fluent in half a dozen of languages (not really) but start learn one so you can gain something out of it instead of gray hairs and stress lines.

After I had my informal conference from my higher level review, they found a duty to assist error. They requested another exam for those issues which was completed later that month. I'm still waiting on the verdict from that exam. Hope you get good results from whatever happens.

Now that you received the letter, you can call the VA number and ask for a status update. They will tell you if an exam has been requested.
