Question

I have a 10% rating SC for my left foot condition and 60% for PTSD for MST  but, now my Iraq war combat stressors are manifesting. I think I need to put a claim in I’m in  treatment with the VA. How should I go about this.  I can’t work I can’t be around anyone... I have 70% SC total.  Should I put in an increase for PTSD or a new claim.  I want to claim TDUI or something. Please send advice or what/which route to go... Thanks.

From what you are saying I would say to file for TDUI and increase in PTSD.  Now if they go to scheduler and you get 100% you would not need the TDUI, but they would figure that out.  I would look up what you need for to submit for TDUI and make sure it is in there for the increase.  I would also file today as if you do not you will miss a month.

Good advice by all but I am going to say that I would not get the IMO right now.  Get DBQ's from your doctors if they are willing and file for PTSD increase and TDIU now.  See what your C&P's say about your condition before investing in an IMO.  You may not need one and get approved without it.  If you are denied then get an IMO and appeal.  I say this because they are expensive and may not be required.  Also if you get an IMO and head to the BVA you are much more assured of a victory without allowing the VA to muddy the waters of your IMO.

I agree too all the above is great information

Here is what I'd do

I would check the mental health chart for the % of the symptoms your having,  go back and look at the rating sheet for the 60% (I never seen a 60%rating for PTSD)

BUT Anyway check your symptoms you have now and if you have more symptoms  that means your PTSD HAD GOT WORSE SINCE YOUR LAST EVALUATION.

I would file for an Increase on your PTSD  It Maybe that your symptoms now would meet the 100% rating criteria.

What they might do is boost your rating up to 70% and inferred the IU   but it would be better for you in my opinion to get the 100%scheduler  because if you want to and able you can work   opposed to getting the IU you can't work  Both pay the same  same benefits  sometimes they give the P&T if they think your condition WILL NOT improve in your life time.

ASK TO BE RATING TO THE FULLEST EXTENT OF THE LAW

Compare your Symptoms with this General Rating Chart  below

General Rating Formula for Mental Disorders

Total occupational and social impairment, due to such symptoms as: gross impairment in thought processes or communication; persistent delusions or hallucinations; grossly inappropriate behavior; persistent danger of hurting self or others; intermittent inability to perform activities of daily living (including maintenance of minimal personal hygiene); disorientation to time or place; memory loss for names of close relatives, own occupation, or own name.100%

Occupational and social impairment, with deficiencies in most areas, such as work, school, family relations, judgment, thinking, or mood, due to such symptoms as: suicidal ideation; obsessional rituals which interfere with routine activities; speech intermittently illogical, obscure, or irrelevant; near-continuous panic or depression affecting the ability to function independently, appropriately and effectively; impaired impulse control (such as unprovoked irritability with periods of violence); spatial disorientation; neglect of personal appearance and hygiene; difficulty in adapting to stressful circumstances (including work or a worklike setting); inability to establish and maintain effective relationships.70%

Occupational and social impairment with reduced reliability and productivity due to such symptoms as: flattened affect; circumstantial, circumlocutory, or stereotyped speech; panic attacks more than once a week; difficulty in understanding complex commands; impairment of short- and long-term memory (e.g., retention of only highly learned material, forgetting to complete tasks); impaired judgment; impaired abstract thinking; disturbances of motivation and mood; difficulty in establishing and maintaining effective work and social relationships.50%

Occupational and social impairment with occasional decrease in work efficiency and intermittent periods of inability to perform occupational tasks (although generally functioning satisfactorily, with routine behavior, self-care, and conversation normal), due to such symptoms as: depressed mood, anxiety, suspiciousness, panic attacks (weekly or less often), chronic sleep impairment, mild memory loss (such as forgetting names, directions, recent events).30%

Occupational and social impairment due to mild or transient symptoms which decrease work efficiency and ability to perform occupational tasks only during periods of significant stress, or symptoms controlled by continuous medication.10%
