Questiuons About New Rating

Question

I apologize for so many questions, but much of this is new to me.

When I am ask at the VAMC what my disability rating is I don`t really know how to answer. I`m 70 IU/P&T,so am I 70 or 100?

My decision said I may be elgible for Champva so I went online and filled out an application and mailed it in. Will I receive cards for wife, daughter and myself and should I maintain Medicare along with it. At present my wife pays for a lousy insurance for me monthly at her work. Should I cancel Medicare or policy wife pays for out of her check or cancel both?

I go to be assigned a primary doctor next week at the VAMC. I have been on Nexium for many years and all of a sudden my wifes policy from work won`t pay for Nexium. They will pay for a knock off, but it isn`t working. I am in big time pain for days...doesn anyone get Nexium from the VAMC?

You are 100% due to unemployability. You get 100% pay. Its sort of like being an acting E-5 in the Army but at least you get full pay.

Veterans deserve real choice for their health care.

Caveman,

Yes it is likely your family is eligable for Champva. You should receive something back from them indicating the acceptance of your dependants in to the program. My opinion is you will want to maintain Medicare, this will give you the option of using the va or useing a private doctor. It has been my experience that the VA Medical Center (dependng on where you live) cannot always meet the medical needs of veterans, even though they are maindated by law. As far as the policy your wife is paying it depends on what you need. If you use Medicare and your wife's private insurance chances are you are not paying any out of pocket for your care. If Champva is anything like tricare, then your wife private insurance used in conjuction with champva will likely cover all needs without out of pocket expenses. Either way, you will need to decide what is best for you and what you can afford to do.

I can answer you quetion about Nexium, but the va does have Prevacid which works wonders on my Acid Reflux problem. If it is determined that you must have Nexium, and it is not a drug normally carried, your doctor can still request it. In my case my doctor has request specil drugs for my asthma/copd problems.

Technically you are rated 70% with special monthly compensation (IU), but if you tell most people this they will not understand you. Like Pete said it is somewhat like being an acting sergeant except you get the pay. If someone ask, and you want just tell the, just asy your 100% disabled, because this is what the va considers you to be regardless of how you got there.

I hope this answers your questions.

i agree with rick, just tell them you are 100% because for all intents and purposes of your va medical care that is what you are.

not sure on the medicare question, i kept mine and a separate private policy i got from last employer because i am out on total disability from them, it pays till i turn 65 and of course i have the va. but i am overly cautious and always on guard for catasphoric things to happen, but i am working on that in therapy :)

i use the va for my pysch doc and therapist and couldn't be happier with them. i got to a private dentist using my private dental insurance, and i've got a private doc who takes both the medicare and my private insurance. i like having her because if i have a problem it's pretty easy to get into see her.

you may if you can afford it hold on to your medicare part b, if you cancel and then want it back at a latter date it will be very expensive.

I am writing my memoirs and would love it if you could help a shipmate out and look at it.

I've had a few challenges, perhaps the same as you. I relate them here to demonstrate that we can learn, overcome, and find purpose in life.

The stories can be harrowing to read; they were challenging to live. Remember that each story taught me something I would need once I found my purpose, and my purpose was and is HadIt.com Veterans.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
