Correcting Error

Question

Hi Everyone

Recently my attorney and the VA Regional office did my HLR, the case went to closed and then it opened back up saying that the VA found errors that they had to correct. So about an hour ago I received a phone call from the VA to do another C&P exam. I wanted to know is this common for the VA to do when they say they are correcting errors.

IF thats what the error was about, yes. It could have been a duty to assist error where they didnt request an examination for something that should have had one, for example. I see that sometimes. I don't usually work appeals, but I see it in the overall history when im reading through things.

This is my 4th C&P for SC of migraines, the person that called me told me that they are missing a few pieces before they can make a decision.

It could be that the previous examiner(s) didn't form the opinion correctly and it got missed by rating (who should have deferred it and kicked it back to one of us to send as a rework to the examiner), or their opinion/rationale was insufficient or not detailed enough.

Headaches are one of the hardest claims to get service connected and then the rating percentage seems off most of the time. Headaches are subjective(they are based on the individual), how one individual handles a headache may be totally different than another. The VA language uses the word prostrating (to lay down or to incapacitate) but (prostrating) is not a common word for most individuals nor doctors. Good luck with your claim  and if you have any questions please come back, as @Broken said, it could be for any reason that the C & P exam is not complete or inadequate for rating purposes.
