Question
Berta
There are some weird claims at the BVA.
What gets me is the time they take from valid claims.
http://www.va.gov/vetapp96/files1/9605113.txt
"The veteran contends, in effect, that he is permanently
precluded from performing any substantially gainful
employment due to paralysis. He asserts that his disability
is not the product of willful misconduct. He further
contends that he is entitled to special monthly pension based
on the need for aid and attendance or at the housebound rate."
The vet shot his wife and the cops shot the vet and the resulting paralysis of the veteran is from that.
Order
"Accordingly, as the
veteran’s disability is the result of his own willful
misconduct, his claims must be denied."
A widow however years ago shot and killed her vet husband in apparent self defense.
She served jail times for many years however-finally got out of jail and the VA awarded her DIC due to finding that the veteran's PTSD from service had contributed to his death by virtue of years of documented violence towards his wife which the VA felt was due to his PTSD and in this way the veteran himself had caused the fatal gun shot that the wife fired because of his PTSD as contributing to his death.
GRADUATE ! Nov 2nd 2007 American Military University !
When thousands of Americans faced annihilation in the 1800s Chief
Osceola's response to his people, the Seminoles, was
simply "They(the US Army)have guns, but so do we."
Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
