Received Award Letter...finally

Well on April 5 2007 I received my golden envelope with they award letter in it. This was from my initial claim from Oct. 2005. I did receive an award in Oct. 06, but the 2nd claim was deferred for additional development. Well I got 10% SC for my knee for osteoarthritis , but of course kept my combined rating the same (va math...gotta love it). I am happy with this decision it was right on in my opinion. In any case, In Nov. 06 my vet rep and I submitted for IU, within days of my initial award. In this award letter is stated that the IU was deferred pending a C&P. Well today I received a certified letter for a C&P for May 17th. Wow much faster than the last deferred issue. Things are going smoothly now. Well as of the 6th of April my vet rep and I submitted more info for my IU as well as getting a secondary claim on 3 other issues. We even submitted a picture of the scar in the back of my head form the brain surgey (11" scar and the picture still showed all the staples in my head) along with another letter from my neurologists stating I cannot work, how much worse my condition has become snce the surgery and that I will not get better, ever. I also submitted other doctor letter giving my secondary condition a direct connection to my SC injury and I mean direct. My doc wrote that my first condition directly caused my second condition. well, I was wondering, should I bring copies of what my vet rep submitted and give it to my doctor at the C&P exam? Should I bring other pictures? I do not want to get denied because I don't "look" like I have serious health issues. Should I bring another person with me? and How long does it usually take to get an award/decision after a C&P is done?

Tamara- you are doing very well in handling your claims-

I would sure bring the pictures and someone with me to the C & P- they might not let anyone else there-dont know but the pictures will sure help.I would bring the other stuff too-from any doc that has found your condition is TDIU and sounds definitely like P & T too.

HAve you accessed the Blank C & P that you can expect to get?

Tamara:

You are doing a great job on your claim and if you are happy continue on. Your C&P should get into the issues you describe in your Post.

Be sure and bring up not being able to work in your C&P. You may consider a statement for the examination which they would need to address.

Being disabled and not looking disabled is a good thing in my opinion. Lets us move around with the so called normal people.

Should I tell my vet rep that I am going to bring pictures and documents with me? I figure I would bring the letter the doctors wrote even though we submitted them, just in case they arent in my file yes since we just sent them the beginning of the month. Also I figure I would bring printouts of all the chiari information stating there is no cure and all the symptoms.

You could tell your rep but if they seem unsupportive- bring the stuff anyhow.

Years ago when the DAV represented first my husband and then me- everytime I found significant evidence I called the DAV rep but he was always negative about it.

When my husband got a SSA award for PTSD and I had gotten COVA to fax me Washington V Derminski and Murincsak( two cases that show that a SSA determination is probative evidence of unemployability for VA claims),

he just said the SSA award might help, might not-and he never heard of the 2 COVA cases I used too.I didnt tell Rod how negative he sounded.

As a widow on their POA he told me first I had NO claims, then when I reminded him I knew I could re-open the veteran's claims,under established VA case law,he changed what he said but continually said I would never succeed on any of them and always knocked down my evidence.I won them all.

I just dont want any vet to get negativity-your rep might NOT be like that at all-from a rep as to their evidence and what they should or should not bring to a C & P or send to the VA.

I hope they support this and I think your idea on this is EXcellent!

It has been my experience that there is no such thing as too MUCH information, pictures especially....

Congratulations, and I hope that the rest comes into line.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
