Repeat C&P Exam

Question

Hello all, I filed for an increase on several contentions as well as some new contentions in February 2015 and had my C&P exams conducted in August 2015.  I just received a call to schedule C&Ps for the same exams previously conducted in August 2015, with the same doctors as well as with a mental health doctor.  I suspect this is common if there is a question from the rater, my question is has this happened before to anyone else or am I just being paranoid?  Thanks for any input...

Thanks for the quick responses..I asked the C&P scheduler about the exam and she stated that they were asked to schedule another C&P exam with the General Medicine doctor for my Gulf War Illness contentions as well as Mental Health.  I went to the C&P in August which was scheduled for 3 hours and the doctor said that she reviewed my records and kept me in there for 38 minutes and sent me on my way.  Now I'm scheduled again for a 2 hour exam with the same doctor and the Mental Health doctor a week apart.  The exams are both scheduled on consecutive Tuesdays, October 6th & 13th.

Well, I guess they were being legitimate this time

I thank you all for your responses and appreciate the insight.  I will update once I have completed the exams.  I do not post often but I lurk and learn nearly on a daily basis and I knew someone would come back with valuable knowledge.

Vync..I'm glad that the exams were not scheduled on a Friday at least I know I'm not being scheduled for numbers purposes.

Broncovet..I am certainly not going to blow these appointments off..I was just surprised that they added in a Mental Health exam in addition to repeating the previous exams when I did not claim a mental contention in my claim.

This happened to me for PTSD.

First C&P was unfavorable and had all the wrong information, was very rude and only asked me very few questions then sat on computer for 45 mins. I asked for a reconsideration and supplied them with multiple Mental health providers letters etc. I was scheduled to have an exam in Florida on a Friday and I live in Texas. Made the trip anyways and come to find out it was really in Mississippi, good for my wife she got me to the appt on time but was very, very upset. Then had 2 other psychologist review the finding of the unfavorable and the favorable one. Then a third C&P was setup and I provided all the paperwork and asked why in the hell was I being reviewed so many times even after all the positive evidence. That examiner said he was mad and said in his report I just give into the positive reviews and grant the PTSD on grounds of benefit of the doubt. After everything I provided, incident times (Multiple incidents!!!) proof from news paper articles, etc, multiple mental health providers letters, etc

All this is a way to deny in hopes veteran gives up, misses the exam, etc.

Just make sure to keep all documentation and make sure all your medical records are correct and bring in everything you have to your exams because all my exams none of the examiners had any of the information, just enough information to deny a claim. This is just my two cents.

Saints13...I am speechless as to what you have shared, the main thing going on in my head is "How could this sort of thing happen?"

I plan on attending the exams and even if they are rescheduled three or for times after the next exam I will attend those as all.  As veterans, we should never give up or give in and continue to fight especially for the things as right.

I always fall back to a saying that says.. "Right is right and has never wronged anybody!"

I had a DRO Hearing one time because of a C&P Examiner, they said the exam could not be used for rating purposes , the examiner just ask me a few questions and then stuck his head in the computer for an hour while I just set there  very uncomfortable for me, anyway I went got a private IMO, The VA Examiner didn't make any sense in his report, the DRO believed my private Dr (specialist) IMO report as she followed the VA Guidelines and did everything correct, also the DRO ask me if I was willing to take another C&P exam at a different VA Facility..I said yes sir...then he said well that will not happen, were awarding  you your claim and gave me a thumbs up and expedited my claim that day.

usually you can til if your going to be denied if the Examiner says ''It's not me that makes the decision'' just so you understand that...9 x's out of ten  if an examiner tells a veteran that  you can expect a denial.

Babycourt, I was recently granted service connection on Aug 14, 2015 for two claims.  In late 2013, I was scheduled for SIX c&p exams, three by QTC and three by VES, within weeks of each other, in fact I had just completed the last of the VES exams when I received appt notices, dropped off by UPS(which I thought was odd), for the QTC appts. Of the exams, two were for systemic lupus, THREE were mental evals, I only had one for rheumatoid arthritis, through qtc. Of course, at the time I was p o'ed, however it turned out to be a good thing for me, as one of the doctors for the lupus barely stated his reasoning, and the other went into much more detail(the one I didn't want to go to).  I have noticed that scheduling double exams has become more common, I have heard other vets talking about it at different appointments, keep your head up and remember, bring any pertinent evidence with you to the exams, and keep in mind..while there is a slightly higher chance of one of the docs going against you, there is also a higher chance of getting approved by every one of them and giving VA a very hard time of denying you.  Good luck to you and remember, bring evidence with you to the exams.
