Legal Question
I have a claim that a Lawyer is working for me. I would like to put in another claim, but do not want the new claim to affect the one that the Lawyer is working for me. Can one claim hinder or affect another claim? The Lawyer's staff is willing to look at my new claim and submit it for me, but they generally do not get involved until it reaches the appeals process. Your thoughts. Papa

Mid Year Cola Increase
The U.S. economy grew a better-than-expected 5.7% in the fourth quarter of 2009, marking two straight quarters of GDP growth, the U.S. Commerce Department announced Friday If this holds through the next quarter, do you think we might be headed for a mid year increase, of maybe 5 percent, and if it continues though the end of the fiscal year maybe another 5 percent in December. I, for one, would be willing to not even ask for any retro action if we could get two increase in one year. Or maybe we could be headed for a double digit increase in December. The way I read this is the last two quarters of 2009 would have to be April-June of 09, and July-Sept of 09. I say g…

Comp Claim Retroactive Award Date
If a veteran applies for a certain psych disorder, like depression, but gets SC'd for a partly similar one, like chronic adjustment disorder with depressed mood, what date is used for determining the award of service connection? Is it the date the original pysch compensation claim was submitted as is usually done or is it the date of the C&P exam ( i.e., date of the doctor's diagnosis ) for which the other psych disorder was made or a BVA remand date etc.?

Ssi Warning
i am trying to keep someone from making the same honest mistake i made. i was on ssi and had a claim in for a long time. i did not realize if you won your award that you would have to pay back your ssi payments that you recieved . i wound up owing around $4000 and they are taking about $60 a month out of my retirement check every month. also i applied for a credit card and was turned down because they said i had a lien,so now my credit is messed up,there goes my v.a. loan i was hoping to get. i just did not know ,seems like the v.a. and social security would get together and deduct this for you to start with.i am screwed now as far as getting a v.a. loan to get …

38 Usc 1154 ( B )
Could someone put up a link to 38 USC 1154? This law is one which V.A. seems to disregard often. In section ( b ) of 38 USC 1154, V.A. is supposed to service connect conditions for veterans who have engaged in combat with the enemy. I believe that V.A. considered this law when V.A. granted my father service connection for a hearing loss from WWII. Dad's records had burned in the fire at the National Personnel Records Center but he submitted a copy of his DD214 Army discharge showing he had been stationed in Italy, Belgium, and North Africa during WWII and had 2 bronze stars. My dad also submitted a statement explaining that he served in the tank corps in North Africa…

Not for me, but is there a new ruling on this, that non-service-connected veterans can receive aid & attendant benefits, same as service-connected veterans? Thanks much for any info!

Reduced Benefits
Ok, My neighbor who is a retired Senior Chief and Viet Nam Vet requested an increase of his SC right knee and non-service connected left knee. After his C&P exam he just received a letter telling him the VA feels his right knee is better and as a result is going to reduce his Comp from 60% down to 30%. We just turned in a 4138 requesting a hearing and scheduled an appt with his civilian ortho doc to provide documented evidence that his right knee has infact gotten worse. The C&P doctor had him straighten his leg 2-3 times and called it "repetitive movement". This is a joke and not reptitive, this is a man who cannot climb stairs without difficulty, who cannot…

Lejune Toxic Water Bill Is Dead.
The toxic water bill, submitted by Republican Senator Richard Burr, (North Carolina) has been killed in committee. The democrats argued that Veterans/dependents only deserved 5 years of benefits for exposure to this. http://www2.journalnow.com/content/2010/ja...une-water-bill/
