Nod And Dro In Progress, Questions
I got a va letter for my NOD with DRO request, it simply describes 'how the va will try to resolve my disagreement' and 'how the postdecision review process works', very simple. (letter came about within 45 days, dated same day I status checked on 1-800!) My Questions; a'one. How are the dates sorted out - Is the EED current claims rating or NOD filed date the new EED? a'two. Was I supposed to recieve VCAA as of yet, or is that to come with another letter? Thanks.cg

Need Link For Psychiatric Exam.
Paul, You posted the link for "Psychiatric Examination" for me to take to the doctor to do the IME by VA regulations. The first doctor, who did the IME for me two years, who lost the records, called today and wants to do another the 11th of January. I am going to give him another go around. If he doesn't work out, I will still have time to see the more expensive one. I don't believe legally the office could purge those records of a tad over two years old. Maybe I have him over a barrel. I need some advice I am 100% perment & total PTSD is 80% right knee 20% left knee 10% and Tinnitus 10% now the VA Hospital is looking just now getting around to my TBI and they say I have tested positive for TBI should I open a clame up for that even though I am 100% perment & total?

Quick Question About C&p Exam
Hi all, I'm new to this board. I have found that I don't know as much as I thought about this process ... I had a C&P exam last year for DDD rating upgrade. The doc apparently did not go by the 'checklist', as a lot of things on the checklist did not occur at my C&P exam. When I do my appeal, can I request a different doctor than the one I had last time? If I use a civilian doctor in advance of the appeal, should I take the checklist with me and have him/her fill it out for me? I'm not really sure what direction to go here, any advice is appreciated. Asthma Appeal
Hello! In April of 2007, I submitted an appeal via the DAV for a 30% rating for asthma well within the timeline stated to do so. Though my recent PFT falls in the 30% range (FEV1 @ 60), I have been intubated once, and in the ER more times than I can count in the last year...8? I use my nebulizer and numerous other meds for my asthma daily, and it seems to be under better control. I think I have received systemic cortocosteroids 2 times in the last year, aside from unknown meds given in the ER and intubation. I am unable to work in law enforcement any longer, but have been blessed to re-train through Voc Rehab. Would someone please help me understand a few question…

Need Some Good Old Fashion Hadit Advice What triggers a new GAF? Here is my background…Just started using the VAMC in 07. I have several SC conditions, three of which are 30% each. The one I want to discuss is my SC depression. I’ll spare you the reasons why, but initially my C&P for this was evaluated as a GAF of 60. BTY my Appeal C&P for depression was Feb 07. Does that mean I get one every year? My award letter (after a NOD) said that “we have determined that your pre existing depression was aggravated on active duty and has permanently worsened….. and 30% is awarded, which is a FULL grant of benefits sought on appeal….” Hard to understand tha…

I have a question regarding filing for a chronic condition perhaps someone can help me understand what I need to do so I don't screw this one up Wings posted this in another thread: For the showing of chronic disease in service, there is required a combination of manifestations sufficient to identify the disease entity, and sufficient observation to establish chronicity at the time, as distinguished by merely isolated findings or a diagnosis including the word "chronic." The appeal time limit has past on my last claim, which was denied, you needn't have guessed. I am wondering about trying the process again, but I am afraid it will be denied as well with them saying nothing new and material to reopen the claim.
