hypertension Opinion On Cue
In Jan 05 when I had my stroke they quickly SC'ed it secondary to my SC hypertension and DMII. However, from the start they only awarded a 10 percent rating. DC 8008 plainly, in black and white, states "rate 100 percent for six months, then rate residuals min 10 percent". Now since they did not rate my claim at the 100 percent level are required by 38 CFR DC 8008 is this CUE. I think it is as it is a violation of a regulation. There was no question on medical evidence and they did SC it - they just plain out did not provide the six months at 100 percent as required. In providing me the 10 percent rating, which should have been 100 percent for six months, they never …

Nehmer Case Question
I have read till I'm cross-eyed and confused. I was talking to my mother about DIC and found she was only getting it since 2001 for Dad's death, service connected to DMII Dad died in Dec 93, she filed Apr 94. He also had open claim for DMII and peripheral Neuropathy at time of death. Shouldn't Nehmer back pay her to at least Apr 94. It also looks like his estate should get back pay to original claim for service connection back to 91. Am I barking up wrong tree or should I jump on this with both feet.

ptsd Crsc Questions-please Help
I hope someone on this site can help me figure out if I would possibly qualify for the Army's CRSC program in addition to my VA benefits. There is a bill out in congress that is sure to pass on reducing the qualification of being 20 year retiree to a 15 year retiree for CRSC. Here is my situation- 1- I am 36 yrs old 2- I have 15 good years ( retirement points, no letter) in both active and reserve Army 3- I am currently out (ETS) of the reserve component 4- I am currently rated by the VA @ 40% disability for combat related PTSD and back. Will I qualify for the CRSC program? If so, are payments now or when I would have retired anyway at age 60? This is very con…

A Stab In The Dark Here....va Claims And Overall Care
I'm completely lost and I'm sure this will get a little long.... My husband has a 10% rating for an ankle injury while on active duty. I've been doing ok with the VA up to this point....at least I thought so! I didn't think it would be nearly this hard actually. I'm currently trying to get a higher rating and gerd added to his service connected illnesses but to be honest I think my 6 year old will be eating veggies with no complaints before this is over. My husband is young (31) and had surgery in 2001 on his ankle. He broke all his tendons and ligaments in his ankle and had to have it all reconstructed. Help Understanding
Good day, First thank you all for all the information it has been very helpful and has easied my anxiety. I am retiring from the military and my C&P is coming up. The VA rep who set it up told me I could not claim my breast reduction only the scars. I have several issues I will be claiming and have looked in CFR 38 and breast reductions is covered. I had the surgery after a car accident that injuried my back. For years a doctor told me I would benefit from the reduction but I would not do it. (all documented). I Made A Mistake...
Hi All, Well I have posted several times about my contracted C & P that I had to take even though the Dr. was not a specialist, and the VARO seemed to not care what the VA and private specialists (3 - Dr's) have said even. I did manage to get a IMO in recently. Well, there is a questionaire you fill out - well I did do answer 2 pages regarding my issses and got the FOIA C & P which is way out in left field. Well, today I discovered that I didn't fillout page 3 & 4 of the med questionaire Anyone who reads my file could really answer thoes questions, but now I wounder if that hurt my C & P. 60 Day Suspense
Got the good lady on the 1-800# today. She informed me that as of the 27th(yesterday) my appeal has been assigned to a DRO and a decision should be made in the next 60 days! Well this woman is really one of the best I deal with..she always gives me the straight poop to the best of her abilities. I believe her..funny thing is..Thats what I have been told since 25Sep..that my file was assigned to a DRO on the 25th of Sep, is being reviewed and a decision should be made within 60 days! It appears that they look at the file for 10 minutes..make an input in the computer that the case is being reviewed with a 60 day suspense..then @60 days later..no real progress..just anoth…

C & P Make Sure They Do It Right
This may help in processing and getting your claims through the the system. After submiting claims and receiving denials I started reviewing how the C&P should have been conducted and found in a lot of cases the person did not follow the VA requirements for C&P exminations. Example, for my back problems no range of motions measurements were taken. A requirement for ratings. The guide is called "Clinician's Guide" March 2002. I found this on the internet and printed the whole guide off and put in a binder. It covers every detail and guidence for them to follow in all C&P.
