Smoking Gun Evidence Omitted In Ssoc
Just received a speedy response and a SSOC on some of my secondary conditions that were denied again. In the NOD, I submitted an IMO that directly conflicted with the medical evidence test given by the VA on their exam. It was the most likely hardest to be thrown out, overlooked or explained away by the VA. In the SSOC, the IMO was not listed on the evidence list. Imagine that, Did I expect anything different? I guess my only option now is the BVA on this one! Not a good option for me. More probably, not like a seeable option but that is the only choice. Danang_1969

"millenium Act" Effect On Vietnam Vet?
The "Millenium Act" we are looking for any information on this and how it would effect a Vietnam Veteran's "non-authorised" hospitalization claim. If while a vet is waiting on a determination rating, he is admitied to the ER on a Saturday nite (can't get into a VA facility), for an apparent service connected condition, will the Millenium Act help with the bills even tho the rating has not yet been determined?

Privacy Act Amendment Note
Hi to all, Does anyone know why the Two Quack Psychiatrist sent their copy of my C&P to the Regional Office without any Amendment. Three days later, I picked up a copy at the VAMC. I was astonished by what the lady quack had written down. I immediately sent a " Formal Written Rebuttal" and ask for the incorrect statements to be removed and the medical evidence that had been changed. The quack refused to remove the in- correct statements. When the nurse wrote a " Statement for me", as she saw my confusion after the C&P and treated me with a follow-up telephone call. My How Time Flys
Wow! I have been so busy doing everything else - I haven't had time to work on my DIC claim / accrued benefits claim. But I got my first denial - so I feel like part of the crowd now. I guess a couple good things might have come from that. 1. They have played their "medical" hand first. So at least I know the angle they are taking at the moment. 2. Decision Basis For Not Rating Higher
When the VA renders a Decision and gives you the reason that they are not rating you higher and you satisfactorily address this issue with new and material evidence in your appeal does this: A.) satisfy the VA's evidence requirement allowing them to rate you higher or B.) do they change their Decision basis to another reason to deny you the higher rating? hello legal beagles, the orthopedic doctor placed unfounded, irrelavant, statements in my med. records that had nothing to do with a "second opinion" consult....he stated "my injury of the rt. scapula[i was being seen for shoulder joint pain] was due most likely to my past history of alcohol abuse" as his records reflect a motor vehicle accident back in May....WHAT the h--- does that have to do with an orthopedic consult?????do i have any recourse?? thanks, will [forget the patient advocate..they sleep with the enemy!]

Evidence Based Medicine
Has anyone ever used the Evidence Based Medicine opinions. I was looking into that, but was not sure if anyone has experience with the VA with it. It seems like it would be right up the VA's ally - as it doesn't speculate or so much give opinions as it does a "based on the odds" type thing. I was thinking it might be good for my husband's claim (thus my claim) - as the in-service incurrance would be based on the fact that the 3 cm tumor found 2 years after he retired could not have grown NEARLY that fast -- based on the type of cancer he had. Va Pain Management
I was wondering about VA Pain Management I see a private Dr. for treatment and pain med's if the VA has these meds in generic form do I have to go through pain Mgt to get them filled? or talk to my blue team Doctor? I'm looking to save money on my meds, a service connected injury. Thanks Rick
