Meniere's Operation?
I am currently 30% for Meniere's. I put in for an increase in Nov.2006 and have yet heard anything back. I have not even had a C&P yet. For the last 2 years my Meniere's has significantly increased. My Primary Doctor has been trying everything to help me. I have tried every medication under the table for this. My main complaint is VERTIGO, DAILY and 2/3 Drop attacks weekly!! I have been to the VA Nuerologist, and ENT. In fact, I have been seeing them so routinely, they are like family. They are now talking about operating. Submitted A New Request
Since they denied my last request for increased compensation for my back because there was an appeal pending for the same issue, I decided to send in another letter requesting an increase. I also requested an increase for two other issues one for plantar fasciitis (currently 0%) and the other for my right shoulder (currently 10%). I am currently undergoing physical therapy for the right shoulder. I also requested compensation for my upper back and neck, secondary to the cervical spine, and for my left hip secondary to my right hip. I think I made my AMVET rep mad though. Dole-shalala Report
I am still weeding through this report- but something near the end caught my eye- Under "a Gratifying Accomplishment"---page 24 the commission found that enlistment bonuses were being unpaid to servicemen and women forced to leave the military due to service disability ! DOD -upon hearing from the commission about this -promised retro enlistment bonuses in these cases back to 2001. Ssdi Desicion
I finally won my SSDI claim. It took 2 years and 9 months. My question now is will VA pay me at the 100% rate? I am currently 50% SC and the SSDI claim was approved on one of my SC primarily. It was also approved for a secondary reason. I believe that all I have to do is apply to VA for I/u and send in my SSDI award letter. Is this how it works? Thanks Dalejr #8

diabetes 5 Years Additional Retro
This claim will give a good example of the Nehmer decision: http://www.va.gov/vetapp06/files5/0630309.txt Vet filed for SC of diabetes in 1997 (In country Nam vet) VA denied. BVA denied 2000. Vet files again in Sept 2002. Granted and Awarded 20% back to Sept 5, 2002.due to new DMII regs. The claim for higher than 20% was denied by the BVA. However the claim for EED back to 1997 was granted. The veteran, due to Nehmer, received the EED back to the date of his original denied claim due DMII.

Question On Evidence
For my husband's claim for service connection for lung cancer. He retired from the Air Force after 28 years on Sept 30, 1998. He was diagnosed with lung cancer after a 3.1 cm tumor was detected on August 7, 2000. This was about 10 months past his presumptive period. We have built our case around evidence that due to the growth rate - the cancer was most likely in place approximately 12 - 15 years before it was detected. The Death Certificate gives approximate interval between onset and death as 8 years. If taken literally - that would take it back to February 1999 - which is within his presumptive period. Results Of C&p Exam
I retired in Aug 2000. I mid 2003 a set of symptoms that I was having was diagnosed as IBS. My civilian doc tested and treated for the next 18 months and then decided he could not find a reason for the IBS so I filed a claim in Aug 05 for presumptive SC for IBS due to service in GW1. Finally in June 07 they get around to the claim and send me for an exam. The VA Doc says He had no abdominal problems prior to 2003. He has intermittent constipation, perhaps as much as two days a week and alternates with diarrhea which may be as frequent as five days in a row (I REPORTED CONSTANT INTERMITTENT CONSTIPATION WITH ALTERNATING DIARRHEA). White Envelope
Hope I'm not asking a stupid question. I'm new to this. I retired in April from the AF with 50%. I got my white envelope from the VA today I got 50% from them also. Am I correct that the VA will take 50% of AF pay and make it tax free and then whatever is left is taxed of my original pay and sent to me. Is that correct? My next question is my narrative in my letter states "Since there is likelihood of improvement, the assigned evaluation is not considered permanent and is subject to a future review exam," That means they can bring me back and say hey your doing better and reduce my percentage? at a later date?
