tinnitus New Guy C&p Issues
On 31 Jan 2007 (prior to my retirement physical) my local VA advocate filed an initial claim with the VA based upon information contained in my service medical records. I then underwent a retirement physical and follow-on medical/specialist consults in Feb 2007; I retired effective 01 Mar 2007. I am now preparing a second claim (amended or new) based upon information from my retirement physical and subsequent consults. My question(s) come from my experiences during my initial C&Ps; these exams took place over 3 days at the Miami VA Hospital in May 2007. Injury
I have a veteran friend that two years ago is VA doctor prescribed him a medication called Simvastatin to treat his high cholestarol. One day he recieaved a call from his doctor instructing him to discontinue taking the nmedication because his lab results indicated that the medication was affecting his muscles. Well he was already complainning about chronic pain all over is body and especially his knees making it immpossible to walk. Should he file a cliam for s/c or is there another type of claim he can place. Any help or advice for this veteran will be appreciated.

Reimbersement Of Out Of Pocket Medical Expenses Prior To Rating To Date Of Rating
I was recently rated at 100% total permanent service related for stage 4 lung cancer diagnosed in 01/07. My rating date is May 22,07 and my letter of rating was dated June 22,07 when I went to Togus VA in Augusta Maine to sign up for VA medical and asked about reimbersement for out of pocket expenses nobody knew anything about it. I wrote my congressman and my representative who did not return my emails and waited a week getting more and more pissed because the VET rep at togus was supposed to call me after he researched it .. yep you are right still waiting 2 weeks now. tdiu Reconsideration
I want to ask for a reconsideration on my husbands TDIU award. If I don't have "new" evidence to send in with a reconsideration request, am I stuck with filing an NOD? The TDIU was awarded for the date the "TDIU" request was recieved. It should have been warded for the date the disabilty was awarded by SSA or at least the date of the original claim that met the TDIU criteria. I think they owe about 6 months of retro. PS. Still waiting on COPIES of RECORDS now 8 plus weeks. Jangrin

Filing A Second Claim
I am trying to help out a friend with his claim. I am new at this and I am sure this has been asked before. He has a CUE claim at the DRO now. He was just diagnosed with prostate cancer and skin cancer. He was blue water Navy and served in Vietnam as a pilot. I want to make a claim even if there is a lawsuit going on about the boots on the ground issue. It won't hurt to try. What I don't know is does he have to fill out another claim form , or append the original claim? I don't want to slow down anything. ptsd Has Anyone Filed A "aggravated In-service Claim" For Ptsd?
I was just diagnosed with PTDS since age 9. On my entrance physical, I checked depression, excessive worry, trouble sleeping and diarrhea. I was told that I was just someone who worried a lot and there were men losing their lives in Viet Nam so "suck-it-up". In my judgement and in the judgement of my Licenced Profession Counselor (CSW), my PTSD was aggravated in-service. The trauma was real, but I won't discuss it here. I also had major documented diarhea problems through out my enlistment as well as an operation to remove fissures from my colon. When I was discharged, I still checked trouble sleeping and diarrhea on my discharge physical but checked no on depression. All…

What Can I Do? Who Is Responsible?
I had sudden hearing loss on the 2nd of June and went to the ER at Reno VAMC. They treated me like I was a junkie looking for free drugs and told me to go home and make an appointment with Primary care. I refused and threatened to sleep on the Directors doorstep. To make this short, they have totally neglected my condition for a whole month now and my hearing is absolutely gone. Everything I have read says treatment must begin immediately for any chance of recovery. I still do not have a solid appointment with ENT and I am now concerned that I am permanently deaf........any advice? I want to sue them for neglecting my emergency.

Form 9 Or Reconsideration Or Both
Well I really don't know what to do. I have a SOC from my NOD. The SOC was a partial grant but also didn't even mention several of my other issues. They gave me the SOC prior to the 60 day I requested for time to submit new evidence. Rumor is my file is at final authorization stage. Also told this could take 45 days. My 60 days to file Form 9 runs out in a few weeks. So, do I do a Form 9 and list everything they didn't cover. Do I request a reconsideration on the basis of my new evidence form VA exam? Also what should I do about these 2ndary conditions that the VA Dr found? File a new claim? I am in the process of getting rid of my POA since he was no…
