Bva Question
How do I deal with this from my BVA decision ? "The veteran has also raised the issues of entitlement to service connection for A, B, C, D, and E. These issues have not yet been adjudicated by the RO and are referred to the RO for appropriate action. See Godfrey v. Brown, 7 Vet. App. 398 (1995) (the board does not have jurisdiction of issues not yet adjudicated by the RO)." My evidence shows adjudication is final on A, B, C and D. How do I respond to this, to get BVA to make decisions on these issues. Thanks for your input, carlie

ptsd Tinitus
I've been visiting this site infrequently for some time. I am %50 PTSD and really have a hard time concentrating, so visiting here with all the abreviations ect can be quite frustrating, depending on the day of course. I also have a GS wound to the R arm which is currently at %10. It has been under appeal since 1999 and is now at the Appeals Management Center for over a year. I belive I will get %20 from what I have read. Also from what I have read this will amount to a zero dollar increse, if I am reading it right. However I will be at %70. Then can I file for individual unemployability? I just read that someone is getting %10 for tinitus (ringing in ears) I hav…

Va Id Card
This is a kindda dumb question, but.... My husband has one of the older VA ID cards for the VAMC. Is there an ID card that will show he is a disabled veteran, or does he carry a copy of the award letter in his wallet, does the commisary card also work as an ID card showing disability? Thanks

How Do You Verify That The Va Rated You Correctly?
The reason I ask is that the VARO rated my bilateral hammertoes & bilateral hallux valgus (bunon) as a combined 10% for each foot. Whe I look up these conditions in the CFR hamemr toes is under #5282 as 10% and hallux valgus is under # 5280 as 10%. It seesm that I should have been given 10% rating for bunion, and 10% toes ecah foot. Am I looking at this correctly? Thanks. Joe

Mandamus Petitions
I saw this come up here somewhere and have a few key points on Writs of Mandamus-aka Writ Extraordinaire- basically this is a writ that falls under the All Writs Act, that asks the court to make the VA do something. Most Mandamus petitions at CAVC are requesting the court to get the RO to move on making a decision. They are usually denied. But there are reasons they are denied. The full case law and requirements of a petition for Mandamus can be found at the CAVC web site. I filed one many years ago that was denied because I had not exhausted all avenues of approach through the VA claims process yet- the court was right. I got a little tougher and the VA…

tdiu Denied!
Hi All, Here we go again...Well, I received a letter from my vocah rehab counselor stating that "She made a determination that it is not feasible for you to benefit from a program designed to return you to gainful employment. However, we will be providing you an evaluation for Individualized Living services." Ok...now I received a phone call from a VA representative to set up an appointment to come by my house and complete an evaluation for Independent Living Services. Does anyone know what to expect? What should I do after that? I am currently 70% (Combined & Total disabled) should I file for TDIU? Any advice would be greatly appreciated! Thanks, Cherie…

Received Letter From Ro
Greetings, One of the elderly vets I am helping received a letter from our RO. The vet in question withdrew these claims for Aid & Attendence and Bi-lateral shoulder conditions back in January of 07 when he found out vets could hire attorneys. He did not understand this issue correctly. The RO in sent him a letter in febuary 07 stating they received his letter to withdraw and that he had until April 25th, 2007 to reinstate the claims. Well April 25th came and went. He sent a letter to the RO attention to the Director explaining that his meds made him confused and made a mistake withdrawing these claims. He aslo sent in New and material edivence. He receive a let…

ptsd C & P Ptsd Gaf At 46
First I have to say thankyou to everyone who gave me advice on my previous posts. Had a C& P on Friday picked up a copy today. Appears to be thorough and all issues appear to be addressed. Dr gave a GAF of 46 current and then said GAF 44 to 49 for past year. I am a Vietnam Cobat Vet. 1. Does the VA rely soley on the scores or will they consider all the other evidence on the C & P. I guess I am asking is there any way of determing what type of rating will be given with these GAF scores. Thanks Rich
